Yep, agreed again. Even taking time off and losing a days pay is probably worth it. If your savings are there for "a rainy day", then its started raining now. A solicitor wont "get you off" if youve committed an offence, but may put your side of the story in such a way as to get a lesser fine or other penalty.

Although the advice on seeking legal advice is bang on I have took a quick peak at the offences mentioned on the other thread and they appear to be correct.

I’m no expert in transport law so treat this post as layman’s advice.

Regarding the statement of means your mentioning do not try and hide savings, they have seen it all before and I believe the judge won’t take into account savings in your case, all they will be used for is to show your ability to pay the fine rather than how much.

Your income vs expenditure will be used to determine how much you pay based on what the judge can hand out in his fine limits.
Don’t panic unless you’ve been a really naughty boy the fine imposed won’t be the max.

Make sure you have proof of all your Income and outgoings to give to the court.

If making a guilty plea which is probably what a solicitor would recommend unless they find a glaring innacuracy that could get the case thrown out, be prepared to explain how and why the offences occurred and any mitigating circumstances which may or may not be taken into consideration. I believe this is known as a plea in mitigation but research or preferably pro legal advice will explain this option better and also advise if it’s viable.

Appear at court presentable and prepared to pay the fine on the day.

Do not falsify the statement of circumstance the fine for this is £2500 I believe and can get you in deeper do do…

If you cannot pay the fine in the timeframe specified by the court you may go to prison.

Be bloody honest, falsifying records has got you in this mess in the first place.

Best of luck you will be OK, worse things happen at sea.

ok…to be fair,i think adolf was a legend and knew how to throw a god party,and its always been a shame that he took on the ruskies before wiping the floor with the uk.we prob would be speaking german nowadays but how better would the quality of life be… :slight_smile:

From knowing of charge to going to court ive a couple of weeks , so yes I guess the know when large sums disappeared out of our accounts why , filled it in now and will see what the day brings ta

Best to turn up in your best bib & tucker. If you’re not using a solicitor you can always ask at the court for the duty solicitor. They will speak on your behalf free of charge. If you’re going to conduct your own case, write out what you want to say & ask the Magistrates if you can read it out as you’ve never been in court before & you’re nervous. The means form is used to check your ability to pay any fine and they do take your savings into account as my mate will testify when he was done.

Ta , not sure about saying I’ve never been in court as have a fair few times ( not of late though ) , can they check ? , I guess they can .
I’m normally dragged up from cells and just can’t ever remember filling in a form for my personnel circumstance , just fined , and while ago bound over too keep peace ,

I’m not sure this will be a fixed penalty , my understanding is as Raymond says elsewhere , up too £2500 ( I originally read it as up to £5000 and a possibility of 2 years in jail .
But my issue is our saving our joint saving , now fair enough fine me , but it seems unfair too fine the Mrs as well as she has no involvement in this .
Strange thing is it was only the other week I / Mrs were saying too our girl if your in a relationship that saying That’s my bill , that’s your bill , halves on meals , holidays , separate saving was not how it should be , it should be like we do just chuck our wages in pot and savings ours , holidays are paid joint elegy
But now I’m thinking separate savings accounts would be a better idea .
There even asking what Mrs earns , what revels lance has that got to do with me being fined
What happens if she earnt £700 pw and I earnt £200 , surely it should be just on my wages not hers

I’m a bit baffled by this form as I’ve just been fined before , bound over for so much , never filled in a personel circumstances form before ., surely a fine should be a set amount , not how much you’ve got in isa ,s , bonds etc :unamused: ta

My mate has just been done over for fighting at football and got a fine of about £800, the courts looked into his finances and noticed he had got £10,000 which is part of what his dad had left in his will when he died and he is saving it in his account for his mum.
The courts are now chasing him for a hell of a lot more money now :unamused:
