Contesting speeding ticket

Not a copper mate, never have been. But have needed their assistance on more than one occasion.
All coppers are ■■■■■■■■ - just the same as saying all truckers are fat lazy drunkards (present company excepted). Generalisations are very popular with some people…

Maybe his gun was set for km/h as 44 mph is just under 30mph (27,34 mph) exactly.

have been summoned to court, in november, in the next county?.. i can go to court and plead guilty but can only plead not guilty by post?.. also the police officers witness statement for the prosecution says , and this is all its says , that i asked to be let off as im an hgv driver… that is a lie! i never asked to be let off anything as i had not done anything, a letter is being sent with my not guilty plea, surely it is upto them to prove without reasonable doubt that i was speeding not for me to prove that i was within in the law… nay ideas why i would be summoned to court in the next county nearly 70 miles away, the alleged offence took place in pembrokeshire and the officer was from the police station here and we have a magistrtes court…

No idea why its in the next county. On what basis are you pleading not guilty? I’m not being funny with you, but its no good going to court saying i wasn’t speeding if a copper says you where. If he ‘thinks’ you where speeding and he says his speed gun confirms it, then unfortunateley that is ‘beyond all reasonable doubt’. Just trying to save you time and money !!!

I know you’ve already said you wheren’t speeding. I’m asking you what you have as evidence that you where not, because from what you’ve told us you will definatley be found guilty. So, what do you have, just your word for it?

But, in the same respect, if you definately weren’t speeding, good on you for fighting it.

Too many people bend over and take it because they’re scared of getting found guilty, if you’re innocent then you shouldn’t be found guilty.

If more people fought some of the crap we have to put up with, then maybe there’d be fewer horror stories.

I’ve lost count of the number of times I’ve been in court but on a few occasions (3) when I felt I had an argument I appeared personally and presented my case to the magistrates. I won on each occasion in spite of the record the magistrates have in front of them. You must appear in person to have any chance and it should go without saying “suited and booted with a fresh shave and haircut!”. You might not be the only one challenging this copper…? Do your homework and also ask why the case is not being heard locally, that seems strange to me? Do not, under any circumstances, appoint a lawyer :angry:

contest it!!! I did the same in similar circumstances, wrote a letter to the court pleading not guilty, the reasons and witness statements from 3 other guys who were in the car at the time, got thrown out…

tbh i was,nt speeding,

on another occasion when i may have been, the ticket given stated the wrong vehicle, again thrown out…

a police friend of mine in the met reckons on average 80% of contested tickets are thrown out, as they either dont have the time ect to spend obtaining further info/ or they know its a lost case…

Wayne, i agree with your take on it. I’ve been to court twice, once for a fixed gatso and once for the same camera as he had, However in both them cases i seen a way out,i was not found not guilty but the case could not go any further as they where not allowed to produce their evidence.So i ‘got off’ . if he’s gonna rely on " i wasn’t speeding" then he’ll be done. Anyone wanna run a book on it?

I agree. Need a better story than that, even if it is true. Also the 2 “friends” in the car with him as witnesses won’t ‘wash’ with the magistrate either. GAR!

in my case, which is similar to the o/p,s, i was driving with 3 work colleaques in the vehicle, on a road notorius for a copper hiding in a bus stop, we also had a base about 2 miles past this bus stop with several guys mobile and radio communication, I knew that the copper was in the bus stop and my speed was 30+ but limit was 40, an approaching bus stop he flagged me down, saying i was doing 45-50mph, I told him no way and my colleaques backed me up, his device for catching my speed was a watch! timing me between 2 white squares painted on the road■■? anyways he procedded with the ticket and it went to court, the outcome as stated thrown out…

my wife is contesting a gasco one at the moment as the picture issued is taken from behind and we cannot identify the driver :confused: the car as 3 named drivers as well as other none named but 3rd party drivers… during a telephone call she was told to put it in writing and 99% sure that it will be scrapped…

You said he showed you his speed gun at 44mph how do you know that was your speed it could of been a previous car he nicked and did not cancel and reset the speed gun just a thought as you are adamant you were under 30 mph.

i have sent my NOT GUILTY plea in the post along with a long letter, as much as i would like to attend court in person I am not able too due a being away on a pre booked holiday, i have put copies of tickets etc to prove this fact, we shall see what happens, im not bending over and taking it as i did not do it… i did state in my letter that the only reason at the time we could i was being puled for was that there were three guys in the car on a saturday evening and he perhaps thought that i had a drink…

AFAIK, all the gatso cameras take 2 pictures from behind, to identify the reg of the vehicle. Don’t think they are intended to recognise the driver. I take it you mean 3 named drivers on the insurance policy. A vehicle can only have 1 registered keeper, but may be owned by someone else.

So an NIP has been sent to the registered keeper, it’s down to them to either confirm they are the driver at the time or say who the driver was, so they can be prosecuted.

Sorry I can’t see from what you’ve said, how it can be contested.

Again I’m not so sure it’s that easy and you could potentially end up lumbered with an MS90 which is 6 points and causes problems with future insurance if you’re not careful :slight_smile:
