Compulsory WTD break after 12hr?

Hi guys,

Not sure if this happen to any of you yet, but I did a total of 13 hours 45 mins shift yesterday!!! what a long day starting from 6am for a class 1 job.

I’m an agency driver since I passed my class 1 last year, this is the first time I’ve done over 12 hours, and I’m trying to find out how much break I should be taking (legally).

Now the Working Time Directive state that I must take a 30mins break for 6 hours of work, and another 15mins after 9 hours, but no mention after 12 hours.

So, assuming another 15mins after 12 hours? or I don’t need to (legally)?

I’m trying to cut down my break time because the agency don’t pay for my break.

A shift of more than 9 hours working time requires you to have a total of 45 minutes break/breaks for the working time regulations.

Breaks for the working time regulations can be taken in segments of 15 minutes or more.

Driving breaks also count as working time breaks and where appropriate vise versa.

At no time during the shift should you do more than 6 hours working time without a break of at-least 15 minutes.

Most companies will not pay for the first 45 minutes of break, if your agency are not paying you for legally required breaks after the first 45 minutes, find another agency :wink:

trouble is as you know you can do a 15 hour shift with only 45 min break

If your getting paid breaks or not. Anyone should always take adequate breaks .either 15 and 30 or full 45.
Non of this don’t get paid so not taking one.
Just take the proper breaks if it makes your day longer or you don’t get all you jobs done not your problem.
Never understood anyone who does long day taking a break in a qué on the pumps etc.
Have a proper break your feel more refreshed after it.
Plus personally if you get stopped an hour a day break.
I’d take the full hour off

Some absolute idiots consider breaks as something they ‘have to get out the way’ or ‘get in’,… a bit like their 2 × 11 hour daily rests in their self inflicted stressed and crap work lives.:roll_eyes:

Breaks are there for the very few driver welfare purposes that are in the job, not for your boss and/or you to get around your drops in time.

It is one thing putting tacho on break for your convenience, then taking a ‘proper’ break when it is better suited to yourself a bit later on.

Not taking them at all in order to achieve a work load ?..
Well you are just terminaly 'kin thick and deserve everything coming to you.
Thing is though, the poor innocent ■■■■ you may well injure (or worse) by your falling asleep at the wheel, does not deserve it…Especially if it is gonna be me.
Something I feel very strongly about.
