EXPLANATION -
the last sunday and Monday off are used as the regular weekly rest for the week with the day you asked about

the last Tuesday is used as a reduced weekly rest for the week which starts on the last Monday

when is the next weekly rest and for how many days after that list ends?

So for where my weekly rests are… They’re in the following order…

Regular - reduced - reduced - regular

So I am ok to have two reduced in a row as long as I’ve got a regular at each end of the reduced weeks?

After the sun/mon/tue off I’m working wed/Thursday/fri then have 2 and a bit weeks off.

You last week before holls is also a regular weekly rest as well as having a reduced weekly rest which will not need compensation

Showing more than one reduced weekly rest in a row is not the same as using two reduced weekly rests in a row for two weeks in a row

A driver could work alternate days for say 12 days - that would loads of reduced weekly rests in a row

If after your holls you start on a Monday then you will already have a regular weekly rest for that week because the last 45 hours of your holls will count for that

Hi this is my first post. I have looked for answers all over the internet and from what I have read I am pretty sure I have been told wrong and have now got an infringement.

I worked 5 nights in a row and took a normall weekly rest about 60 hours i then worked the following 6 nights followed by a reduced weekly rest then another 6 shifts followed by another reduced rest. I told my company after that i required a regular weekly rest but they insisted i didn’t. I spoke to a couple of people and they said I was fine aslong as I pay it back by the end of the 3rd week. So I took a reduced weekly rest it was only when I inserted my digi card into a new unit that it flashed up weekly rest required.

So basically I had 60 hrs rest worked 6 shifts then had 34 hours rest followed by 6 shifts and 37 hours rest and 2 and a half shifts. I know I am fine for working time and driving time I am only worried about the weekly rest I have taken tonight off so I have had 24 hours rest but my company are still insisting I am fine and I need to work tomorrow. And been told I won’t be getting paid for having tonight off even tho i feel they are wrong.

From what I understand I was right and shouldn’t have had 2nd reduced rest and know it’s too late now but I want to make sure I have enough rest now before i return to work and need some information before I tell them I won’t be in.

Does it matter how much weekly rest you have before the beginning of the week as the week before this i had taken about 96 hours rest?

I am really great full for any help i recieve.

Generally the 37 should be a 45 and yes this one does need to be a 45

You might not get an infringement for the 37 but then needs a lot more info to say either way …
Do all your weekly rests include sunday midnight?
If yes, then what have your weekly rests been over the past 10 weeks?

No my weekly rests don’t include sunday nights as I work sunday to thursday nights with Fridays as extra i have had a 96 hour weekly rest then regular rest about 60 hrs then the 2 reduced but before this my average weekly rest is about 60 hrs as I haven’t done overtime for a a couple of months.

The main thing I am bothered about is they are trying to get me to work tonight even tho i now have only had about 30 hrs rest then have my normall 60 hrs off from Friday morning until Sunday night. They are telling me all tho I had reduced rest on Saturday i would have still been ok to work 5 days this week but I made the decision to come home as it flashed up weekly rest due on the tacho in one of our new units and I was just going to return to work on Sunday.

You can work tonight as it will make no difference to your weekly rests

Assuming you had a regular weekly rest for the week before this lot …
You had 34 off = reduced for week 1 which leaves 11 to be paid back before the end of week 4
You had 37 off = reduced for week 2 which leaves 8 to be paid back before the end of week 5
You can have about 60 off starting on Friday morning for week 3 which will pay back the 11 from week 1
That still leaves the 8 payback from week 2 which you need to sort out before the end of week 5

It still leaves an infringement of insufficient weekly rest from week 2 which you cannot do anything about

Having Wednesday night off will make no difference whatsoever, nor will having Thursday night off make any difference, the important thing is that you have a regular 45 hour weekly rest period this week starting any-time before midnight Sunday.
