I have just had a container put on and go to the out gate, I stop leaving the engine on digi tacho is showing other work, it takes me less than a minute to walk round to do the twist locks, then move forward, is it down to me if the digi tacho doesn’t actually record or is it down to the tacho.
No non believers on this one please I did a print out after I stopped again and it hadn’t recorded it.
I arrive at delivery point put the container on the bay, I am then told it will be 3 hours to tip, can I legally have tacho on break for the 3 hours.
I don’t ever use POA, I have no need.

Presumably you mean it didn’t record the “other work” but recorded the time as driving, I assume you’re using one of the old type digital tachographs that will continue to record “driving” for the entire minute.
You probably wasn’t stopped for long enough to record “other work”.

Yes you can use “break” as long as you’re not doing any work.
If your tachograph is on “rest” for 3 consecutive hours or more you can count it as the first part of a split daily rest period if you want.

And also on the break part, that is what I would normaly do any way if it happens early in the week, to get the 11s out the way.
I had to ask the 2nd question, as I was having an argument with an idiot about it, and if I had carried on I woulda probably lost haha.

I think you’ll find it’s recorded the time but not as other work, it will be recorded as driving instead.
You can lose a minute of driving time every time you stop because the tachograph will continue to record driving time for the completion of the minute no matter what you’re doing.

No offence comitted, the time is simply being recorded as driving instead of other work, that’s simply the way the first generation of digital tachos work. Not a lot you can do about it.

So, on that bomb shell, would you agree the records on the other post could actually be a true account of my working day, well apart from the fact the unit being incapable of actually recording it properly?

I stand by my comment on that thread that 28 minutes of other work in 3 days is unlikely to be a true record as after your 5 minutes per day for statutory checks it only leaves 13 minutes of other work in 3 shifts. If, as you have suggested, you often do 600-700km per shift, I would suggest that 13 minutes isn’t really even enough time to put enough derv in your vehicle to do those 3 days work, and even with the limitations of the first generation of digital tachograph I find it unlikely that there wasn’t ever in 3 days a couple of minutes here and there when you were taking paperwork into an office or similar that got recorded as other work.
I could be wrong though of course, and as you have pointed out elsewhere what I think isn’t really relevant as long as the ministry are happy.
