Any idea what kind of punishment could be issued for winding

Wont go into too much detail but I jacked a job on Fri after being fed up with the unrealistic timings the planner was giving(amongst many other reasons but this was the final straw as it was my fault one of his timings wouldnt be met after planned me to a 12 hour driving day) and after having another driver bragging about winding his clock on and me challenging the planner his response was “I asked if it is achievable and the driver says yes it has nothing to do with me how it is done” :unamused: I told him if he eased up a bit and stopped trying to push us he would not not need drivers running bent to get work done. Now I know that many might say that it isnt my place to stick my nose in but the planner had specifically asked my gaffa to get me a truck without a digi card as they are “no good” and he had hinted a few times I could pull my card out to drive into a yard at the end of a day or beginning and start the shift once loaded etc which I refused.
Now I understand folk who want to get home for the weekend driving on a bit longer to get home but this driver puled over just before dartford tunnel at 2200 and wound his clock on 9 hours and started his new day at 0700 and did a further 10 hour shift so this planners 0400 met its delivery slot :unamused: then saying how effed he was but when the job needs doing the job needs doing :open_mouth:
I know the max for the driver is 5k fine and up to 2 years in the nick but if he was caught what would could happen to the gaffa? The lad who runs the trucks had no o license for 2 of them despite running 4. Had no way of reading my digi card and even though had no HGV being 19 he used to drive my truck at the weekends :unamused:
I know I well rid of a place like this but they all seem to think it is normal :smiling_imp: Is it normal? :smiley:
And what could the gaffa/planner be punished or are their hands washed of it?
Might be worth a mention the trucks he runs arent on his o license its his dads and the trucks dont go anywhere near the place that they are supposed to and as mentioned has 4 trucks and 2 of them are on o license.

GTF out. Problem is that this the kind of outfit that will undercut operators who aren’t running bent, so we all suffer.

I am out, left on friday and started new job at clearway nottingham today. Money is a bit on the low side but they seem a decent bunch of lads and I am glad and lucky to be at work so soon after leaving last week.
Now the ■■■■ is ignoring my phone calls and texts and I think he is going to try and not pay me :unamused:

Thanks, I think he honestly believes that I will just go away and forget about it such is the stupidity of this lad! I dont want to go down the grassing root as it wont just be this lad but his driver who ends up right in the brown stuff but I need that money and dont know what else to do. Tax evasion is another thing I forgot to mention he hasnt and wont provide payslips proving my contributions to n.i and tax etc so he clearly hasnt paid mine or the other lads tax so his potential fine is becoming much higher then paying me £500 :unamused:

To answer the original question.

In court last month and a ‘false record’ involving the use of two driver cards cost the driver; fine £450, victim surcharge £ 15 and contribution towards prosecution costs £ 2 500. There is also a guarantee that the driver will be going for coffee and biscuits with the local TC, I can surmise that said driver will not be keeping his vocational license, if a recent case in Scotland is anything to go by.

Just to add, this was the drivers’ second offence within five years.

As far as the operator is concerned, the maximum fine is £ 5 000 per offence. A recent hours/records case here in Nottingham resulted in fines of £ 17 000 and costs of £ 90 000 being awarded against the PSV operator for a guilty plea to 77 offences.
