Any 5 From 7 Contract

With Xmas fast approaching I have a contract that states I have to work 6 days, ok, but am I still entitled to the minimum weekly rest period of 45 hours after the 6 days work ?

Or are you talking about the occasional six shifts ?

You can work six shifts and have a reduced weekly rest period but not every week.

If you’re doing six on two off you will find that eventually you will have to have an extra day off so that the weekly rest period falls partly in the correct week, it will most likely be somewhere around week 9 10 or 11.

I always thought any 5 from 7 meant they could make you work any 5 days they wanted over that particular 7 day week, in other words not having a set day or set days off but maybe i’m wrong.

Wed rest
Thurs rest
Fri wk

That’s how I’ve always thought of it but the OPs saying he’s got a contract to work 6 days, that’s what’s confusing.

My guess is that the company are expecting you to have a reduced weekly rest period to help out during the busy period, whether they can force you to or not I suppose depends on your contract.

Legally you don’t have to have a 45 hour rest every week, so as long as you still comply with the weekly rest requirement in article 8 -6 (EC) 561/2006 there’s nothing to stop them asking you to have one day off instead of two occasionally .
