Looking for some advice. I started working for an agency at the begining of November. As seems to be the norm rates were agreed on a job by job basis, either by text or verbally. My problem is that after the first week I thought my wage was not right. Phoned the agency who said they would look into it. Second weeks wages and still short by my calculations. Another phone call to the agency and I’m told yes there is a problem and it will be rectified in next weeks wage. Third week and still the money is not right. Now I find that I haven’t been paid night rate as agreed for any hours worked after 19.00hrs. Another call and the agency branch manager tells me that rate should never have been agreed and the member of staff who did agree it no longer works for them! All I want is the money I was expecting, although I have incurred bank charges as a result of short pay. Any suggestions?
Job rate by text = they have no chance of not paying
Verbally = good luck with that if one to one
I had a similar problem with Unique Recruitment in Worcester who also go by the name of Staff4U when they owed me two days pay, in a phone call one Friday I said I would be seeing a solicitor the following week, the money was in my bank account the same day
Having said that it’s a bit pointless threatening legal action unless you’re prepared to, and can afford to, go down that route.
I can’t say where you stand legally but if you agreed a certain rate you should be paid that rate regardless of whether or not the person who agreed the rate is still working for the agency.
If you have a text message giving the rates agreed you’re obviously in a good position but I’m sorry to say that verbal agreements over the phone are a problem as you have no proof that a certain rate was agreed.
Look for another agency and good luck in finding an honest one
