Agency Driver claiming mileage allowance

Hi everyone.

I’ve just joined the forum and been having a look around and I’m very impressed with all the knowledge on display.

Having read quite a few posts regarding mileage allowance, I am still a tad confused. I’m hoping some people can give thoughts on my situation before I try to claim tax refunds and the like.

I’ve been working for an agency for the best part of seven years and I’m on PAYE. For every job I do part of my earnings is not taxed and is shown on my pay slip as TRAVEL. Usually this is £6 per days work. Although it can be £10 and sometimes £20 depending on distance travelled to and from work.

I work for multiple companies through my agency, some alot more often than others. The “Temporary/Permanent workplace” rules regarding mileage allowance are another area of confusion for me. Not knowing if it is one or the other. I am usually given work over the phone the day before and sometimes a few days before.

Here is a breakdown of jobs I have done from April 2010 until April 2011:

Note that Job B, D and E are the same company, but different depots.

So the total mileage for this year travelling to and from work is almost 11,000. Travel for this year was £1.430. Works out as 13p per mile. Rather different than 40p per mile that I could claim for the first 10,000 miles?

I have records for jobs all the way back through 6 years. So could I claim for all my correct mileage allowance?

Any advice on any of my points would be most appreciated.

I guess you’re a good boy and keep records of your mileage? Also the fact three of the above are for the same company is irrelevant - its the location that matters.

You can claim the difference between what your agency pay you and the HMRC rates. You’ll need to get a P87 from your local tax office or download one off the interwibble and print it out. Work out what the HMRC amount would be for 11,000 miles (£4250 at 10-11 rates). Deduct from that what your agency has paid you and enter the final total on the P87. Post the P87 to the tax office indicated by your employers PAYE reference ( the 123/ABCD one on your P60 ) as with many agencies their pay office is in a different tax district to the office you work for.

When doing the same this year, remember that the HMRC rates for the first 10,000 miles have increased to 45p per mile.

As for claiming for previous years, I think you’re stuffed as all tax affairs for a particular year is counted as completed by the 5th of April the following year. HOWEVER that doesn’t mean I’m right so phone up your local tax office and ask them if you can claim retrospectively.

You don’t actually get paid 40 ppm, you get tax relief on it. Just thought I would mention it as some people think the taxman is going to send them a cheque for £4000.

This may be not be in order but:
I put in a self assesment form rather than p87 even tho I’m totally paye.
You can back date it 6 years with no receipts I did on the advice of Limeyphil and was very surprised.
This last year I have just learned I’m getting a rebate of £1705.
I claim for all uniform, training courses even down to washing clothes.
The Self assesment form looks complicated but I think I only filled in 4 pages tho this year was done online.
The amount if agency drivers I have told this and they have just dismissed it is unbelieveable.
Any questions just ask in this thread.

When you mention training courses, do you mean CPC and ADR? I have done these in previous years.

I also found out you can claim for your digital tachograph card aswell.

Any other thoughts would be welcome.

I got mine through the post this week. Its got even shorter for those with a turnover under £70,000. It is now 4 sides of A4 (an A3 sheet printed on both sides and folded in half). There is a sum total of half a dozen boxes you need to fill in as most of it doesn’t apply.

Alternatively, register online. You’ll get it sorted quicker as someone who works for HMRC said they don’t even open the paper returns until 2 months after October.

Yes you can claim for the training courses.

Personally, I think you’re at the point where an hour spent with a tax accountant would be quite worthwhile.
