Adr and passengers

Can someone tell me the legalities of carrying passengers if pulling an adr load.

Reason is, I might me doing my adr for fertiliser and some farms we goto you pick up the farmer and then he comes with you to where they are using the fertiliser…

ADR has this to say about carrying passengers:

ADR 8.3.1 Passengers
Apart from members of the vehicle crew, no passengers may be carried in transport units carrying dangerous goods.

I’d say that if the carrier (your boss) is aware that the farmer is on board and doesn’t mind, then the farmer can be regarded as a member of the vehicle crew because he’s on board for a good reason. He is also aware of the danger of the fertiliser, so that requirement is also met. Strictly speaking, the farmer needs to have all items of PPE required for that UN Class as per your Instructions In Writing.

The bit about passengers is really there to stop drivers carrying children, random girlfriends or hitch-hikers that aren’t aware of the danger presented by the load, or who don’t have the correct PPE with them.

A common myth is that a passenger also needs to be ADR qualified, but it is just that… a myth. :wink:

Maybe it’s not quite what we’d like to hear, but I think it’s nice to know where the goalposts are before doing anything that might attract some kind of penalty.

It’s defo an offence to carry an unauthorised passenger when carrying an in-scope load of dangerous goods, but I’ve no idea what the penalty might be, or even whether an enforcement officer would decide to enforce it.

If it went to court, a summons would allege a breach of CDG 2009 (as amended) Reg.5 and ADR 2013 8.3.1, even if the young lady is very attractive.
