Accident - advice needed

My friend had an accident today in Cambuslang (at Cambuslang Road rondabout, about 6:45 am if someone witnessed).

He was cycling from Rutherglen towards this estate where Waste Lorries, Nightfreight and Cityling has their depots and the women entered roundabout as she was coming from M74 and hit him. She took him on the bonnet then he felt out to the ground and she drove another 10-15 metres before she stopped. He was quite shocked at the spot, so he just said he’s all right and he picked his bike and started to walk away. Luckily the guy from his work was passing by and he managed to get name and phone number of the lady who caused an accident.

When he calmed down, he realised that he has some injuries (nothing big (I hope), but he attended hospital this afternoon as he was loosing balance and feel dizzy all day long) and his bike (worth over 500) is badly damaged.

He tried to call the lady for insurance details, but she only accused him of not wearing hi-vis and not having lights on the bike (which was not true) and she told him that she’ll report him to the Police. Later I called her and asked politely for insurance details, but she refused to give me any data except registration number. She said that she reported thing to the Rutherglen Police and that she’ll provide the documents to them soon. She weren’t most polite person I ever spoke to, and I had a feeling that she will try to evade responsibility. We went to Rutherglen Police Station but according to the police officer there nothing was reported. He said that he’ll try to call her, but he can’t reach her.

Now: I know that the word of my friend is not enaugh to prove anything and for such a small case Police won’t check her car for any marks of the accident (altogh my friend is sure that there will be many, judging from damages to his bike). So if she would try to refuse that anything happen, what should be his next step? No-win, no-fee lawyer? Searching for a witnesses? (there were couple of pedestrians and some vehicles at the spot when that happened). Or just try to deal directly with the lady?

My friend just bought this new bicycle and he’s not too happy to have it damaged after so short time so he expect her to fix it for him. And, apart of that, he cycles to work every day and now he has to drive a car, and his wife has to get a bus to work (as she was the one using car to get to work).

So every advice will be appreciated.

The police should be able to get the ladys insurance company details for you and then you will be on your own after that.

Tell your mate to either join the CTC(http://www.ctc.org.uk/) or BC(http://new.britishcycling.org.uk/)
He can then use these as his insurance company, and let them and the relative people take the case over, rather then him try and do it himself.

Don’t let her get away with it. As othrs have said the CTC is a good idea, they will give you insurance for accidents like this included in your annual membership.

i think she has 24 hours to report an accident so unless she does she’s already guilty make the police earn their pay for once

Here’s my tips,

  1. Get your mate to report the crash.
  2. The reg of the car will provide the details of her insurance company and who is named driver etc etc.
  3. Get him to go back to the hospital to provide paper work in relation to his injuries.
  4. Let the police investigate it.

Either way if i was him i would report it not wait for her to do it because in the eyes of the LAW a bike on the road is classed as a vehicle, so GET IT REPORTED!!.

We reported that to the Police. They said they will try to reach her - it is still less than 24 hrs. If they don’t come back to us till tomorow, we’ll come back to them and we’ll push them to find her insurance company for us.

He was in hospital. He was checked by a doctor and he seems to be all right, he was given paracetamol (it seems that it’s magical medicament for everything in UK :slight_smile: ) and told to stay at home with some responsible adult and to come back if he will still feel dizzy after couple of days or experience something else. I was the one who drove him to the hospital - he hit his head into the ground, it’s no joke. Once I had car accident, I spent two hours on the spot dealing with the police, then drove home and then collapsed and woke up in my father’s car just before the hospital… And, last but not least, in case of any problems, there will be a record in hospital that he attended.

The bike is still at his work, I advised him to make as many pictures of damages as possible. I think he also should keep all bus tickets, as he can’t travel to work for free any more.

Lol, when I broke my arm the hospital gave me ■■■■■■■■■ pain killers. 30/1000 co-codamol or something. For a wee 8 stone fellow like me, they certainly did the trick :laughing:

They said they won’t seaze her car and looking for damages as no serious injuries are involved.

in future he should ring for the police whilst being at scene of the RTA but either way hope he is fit and healthy and this gets dealt with

Yeah, that’s true, but he was so shocked that he only said “I am all right” and started to walk away… If not the other guy who turned up and took the lady’s phone number, we would have nothing at all…

NEW UPDATE.

Police do not know nothing about accident → it wasn’t reported to them (and it’s well over 24h).

My pal tried to check the registration number and it seems to be fake, but he asked me if I know where it can be checked to be sure (and I am forwarding that question to you, as I don’t know).

And he found some no-win, no-fee lawyers and they seems to be ready to undertake that case…
