8 minutes brake

If your brake is let’s say 8 mins it counts as neither 15mins nor 30 mins. But it is recorded and exists on a printout from a digi unit. Do I substract that 8 mins from my time on duty to get working time (that one that counts towards reference period)?

Is it legal to take 8mins brake?

Break does not count as working time so yes you would subtract it from the duty time, and yes it’s legal to take an 8 minute break it just doesn’t count as a driver break or WTD break.

It’s a popular misconception that a break of less than 15 minutes counts as other work. A break is a break regardless of length, some can be used for legally required breaks while others cannot but they are all breaks.
