If it does not do the job when needed then probably not legal
Yes it will be
Thankyou…I had an issue with my boss…
A defected 5th wheel or dogclip was reported at 1 am and a driver insisted on taking this vehicle out…after the defect was reported…he had done all his checks allegedly and took the vehicle out anyway…
The fault was not fixed until 15:40 on the following afternoon…
once agin thanx.

Depends if its the type of 5th wheel that requires a dog clip?

Then again if it’s fitted surely it’s required.

Yeah but if it doesn’t actually require one you could take it off.

But why take it off ? This has been discussed here before and i’m not sure what the true answer is but for the sake of a second or two i always clip mine in.
As far as I’m aware a dog clip must be used if there’s one fitted.
Personally I always carry a suitable dog clip in my bag just in case I need it, having a spare saves the hassle of defecting the vehicle before a run, I just report the missing/damaged clip so the company can arrange to have another one fitted for the next driver.
Some people may disagree, but as far as I’m concerned a dog clip is a decent secondary safety measure that, as bald bloke says, only takes seconds to fit.
Taken from MOT guide for trucks
“if vehicle has a missing, damaged, seized and or inadequate safety
or locking device.” than there is a reason for failure.

He wasn’t taking it for mot.

So it means if your vehicle is not roadworthy ( reason of doing MOT’s is to check if it is ?! ) you can drive it not roadworthy condition for 364 days in a year ■■? Best of luck. Take your headlights off you need them only for MOT test
OK Seany - This is a quote from VOSA - Categorization of Defects
hope it is enough to make a person who should know more than average Johnny the driver…
“When the vehicle and trailer are
coupled the coupling must be secured
by a device that provides a further
positive mechanical engagement, e.g.
a secondary’ locking device. In some
cases it may not be immediately
evident what this device consists
of.Action must only be taken where
thereis clear evidence that a device is
not present”

Exactly, a spring catch, a secondary lever or a pin will suffice
