I have changed rolls within the company i work for and I have a new contract to sign, which contains the following…
The limit ( of an average of 48 hours per week) mentioned in Regulation 4(1) of the Working Time Regulations 1998 shall not apply to my employment.
Whats your views… and how will this work with the WTD average over 17/26 week rule?

It depends what your new role is.
The fact that the contract quotes the 1998 working time regulations suggests that you’re not a mobile worker in which case, as far as I can remember it’s legal to opt out of the 48 hour average week.
However if you’re still a mobile worker it’s not worth the paper it’s written on.
Thanks for your reply, sorry I should have stated my new role which is still as a driver but also as a vehicle demonstrator for the products we manufacture. my main role tho will still be delivering these vehicles.
There are a few things i am not happy with in the new contract but this one just seems odd !!
