is it true it counts as a 15 hour day, hence you can only do 3 a week?
Yes, because you’re only having 10hrs 59mins daily rest.

13:01 duty = only 10:59 possible rest in 24hr period = counts as reduced rest period because it’s less than 11 hours. Doesn’t matter how much less than 11 hours it is, just the fact it is less than 11 = reduced rest period.

Three between weekly rest periods, you could do up to six in a week with a midweek weekly rest period.
thanks everyone.

Wouldn’t of thought it would be some thing to worry about, if it was done on your last shift of the week.

If you’ve already had three reduced daily rest periods the fact that it’s the last shift of the week makes no difference, it’s till an infringement.
I agree though that even if you don’t have any reduced rest periods available, it’s not something to worry about unless it’s done regularly.
You can do 6 X 15 hour shifts in a week “without” taking a midweek daily rest. In fact I would dare say you can do 12 X 15 hour shifts with only one day off.

Not without having some split daily rest periods you can’t.
Just start a minute later on the next shift, surely?

It doesn’t work like that, when these stories appear in the media, it will say something like a driver drove for 19 hours without taking a daily rest period when they may have actually had 8.59 minutes rest
This is an interesting subject as I just had the same discussion with my employer! Sooo he was right he also said there’s no problems doing 15 hr days, my argument was if I do two 15 that means I’ve then only two 9s within both 24 hour periods! Even though I’ve had more rest, example
I start at 6 am and finish at 9 pm, I start the following day at 6am and finish at 9pm but I then have a break of 14hrs rest, I’m thinking well only 9 of those are in the second 24 hour period regardless of the others.
I was stopped by VOSA a while back and had taken 4 consecutive 9 hr daily breaks, one of these was a split break (3 hours break during the day) so that still left me with 3 x 9s.
Expecting the worst the guy gave me my card back and it’s fine you can go! However one of my daily driving hours was 9hours and 3 mins and he advised me to beware as this was classed as a ten hr day. When I explained I was looking for parking he said in future do a print out stating you went over the 9hrs daily driving to find suitable parking and that would be fine.
But before I left it got the better of me re: the 9hr breaks and I asked him what was the story there, he said listen mate as long as your showing enough rest periods we don’t bother with that much.
Happy days, needless to say I didn’t tell the gaffa!!!
