Can somebody clear up a ploblem my son has regarding the 10 hour rule,
On tuesday he spent 9.15 hoursdriving and returned to base ( into 10hours for the day )
On wednesday he stopped driving at 8.45 hours thinking he could not do 2 x 10 hours on the trot because he should be back to base therefore had to have a night out, on return his boss was not impressed saying he could do 2 x 10 hours in a week.
I was led to belive you could have 2 x 10 hours if you are not returning home ?.
Also what are the rules regarding nights out with a day cab.

Driving time can be extended to 10 hours twice a week irrespective of where you’re going.
As far as I’m aware you can legally only have a night out in the cab if it’s a sleeper cab, legally day cab = going into digs for nights out.
from the sonds of it you won’t have a leg to stand on as has be said earlier you can do 2 x 10 driving in a week irrispective of wether your returning to base or are on a night out. this can be done back to back
as for the sleeping in a day it was an unecessary night out as he could have got back

He would have not made it back to base so stopping at 8.45hrs or 10 hrs makes no odds
Theres nothing in law to say you cant have a night out in a day cab, All the law says is that a bunk must be provided and a fold down bunk in a day cab is perfectly legal.

Right just to clear a few things up. My father posted above as I was getting myself in this crap that I am in now.
I have started a new job on Monday and somehow I seem to have a very big mistake. I am now in the process of collecting information before dropping to VOSA.
On Tuesday I have already done about 9hours and 45 min on Driving not inclucding other work so came back to the yard at 00:10 on wednesday morning. Went back in on Wed morning at 09:30 after 9hr rest. But after 08:55 hrs drive I got caught out in the day cab near newcastle on A1. Not impressed as I had no gear with me at all. Slept rough in the day cab with no sleeper cab - clearly as a new driver still learning the run I did clearly could not be done in the hours I had.

I got the verberal abuse that I should have done 10hrs on the Wednesday to get back to base - but 1hr extra drive wouldn’t even get me back as it 2hrs back to base. So no point really.
This is a complete ■■■■ take - one from this morning - I should change my Tacho settings to break while i am offloading goods. Then you know what I am up against.
Another help - Does anyone know what rules/laws are in place regarding the collection of payment (cash and cheques) from customers whist on delivery.

You can, and in fact given the correct shift circumstances it is possible to do four on the trot. The ‘You can’t do two ten’s on the trot’ thing is one of the most popular misconceptions regarding the tacho rules, probably only beaten by the ‘You can’t do a 9 hour rest at home’ one.

He wasn’t trying to make you run bent, that would only occur if he wanted you to continue past your 10 hours.

I don’t think there are any. There may be company rules but there is nothing illegal in it so I wouldn’t expect there to be any laws regarding it. It can be quite a common thing, I couldn’t even begin to count the number of times I’ve done COD/COC jobs,

Collecting and carrying cash does however bring into play different Health and Safety considerations concerning the amount of cash, the method of storage, and the availability of access to paying it into a bank. After all, many ATM’s provide for deposits and any employer requiring someone to collect significant amounts during their working should be looking at such possibilities.

Nah, airfrieght work generates, or used to, quite a lot of COD/COC jobs. Also done it on European deliveries in this country, collecting the duty or VAT for instance.

Doesn’t every single thing have them poking their noses in these days. How did we manage to get to the 21st century without them?
i think maybe you need to calm down and then read the tacho rules to the point you that you understand them, or go on a tacho course
yes the point of taking break while unload was wrong maybe he ment poa if you were on a bay and knew roughly how long your were likely to be as long a you werent involved in the unloading of the veihcle

I agree with the above post, obviously none of us really knows what’s been said, it sounds like you’ve been getting some stick for a mistake but it will pass … I imagine we’ve all been there, two things you need in this industry m8 are a sense of humour and a thick skin, from what’s been said in this thread I really wouldn’t be involving vosa.
If need be put your case to your employer and then put it down to experience, but preferably just put it down to experience
