Trucker-Millward:
Thanks for all the advice and suggestions so far. I’m not going to think to far ahead.
I’m going to take it step by step and.
Thanks
It looks like you have decided to go ahead despite contrary advice mate, and that’s fair enough imo, horses for courses and all that. I will however add a cautionary note; where I now work full time used to have a policy of only using through an agency “self employed” drivers, there were about 60 of us many of whom had been at the same place every day of the week for over 10 years. When the tax man finally caught up with me my own personal tax bill was a tad over £15k, many others had £20K+ bills land on their doorsteps.
Be careful.
+1
Back in 2006 to 2008 I did the agency thing went down the self employed route.
I was paid nmw and the rest as company bonus so less n.i and less personal tax paid, some of the drivers were using the same accounting company but not paying themselves any wages and declaring all their wages as company bonus.
A few years later got a bill for £1000 unpaid tax managed to get it down to £400.
Dread to think what the tax bills were like for the lads doing it the other way.
To the O/P if you do live near a refinery do you adr yourself then go knocking on some legal fuel company doors.

You need to read the article in Truckstop News issue 335 13th June.
BIG article on SE/Ltd drivers working for haulage companies driving THEIR trucks.
“Loophole” is closing and HMRC are coming and BIG tax bills back dated a few yrs are coming too!!!
“Public enquiry” On going and HMRC will have their pound of flesh as it’s NOT your decision if your SE/Ltd company driving another man’s truck,
your simply a PAYE employee!!!

Tosh!
So your saying the article in Truckstop News is a load of lies then!!!

I have a limited company and work for that company (PAYE) as director. The limited company then uses my ‘personal services’ as a HGV driver to conduct driver services for various haulage companies and employment agencies.
It’s perfectly legal and above board to sell your ‘personal Services’ and charge a fee. It’s no different to an electrician, bricklayer, plasterer etc. HGV driving is no different.
For HMRC to outlaw this practice they would have to abolish employment agencies.

So Honestscott76 you set your rates which would need to be at least £20 per hour to cover costs, what about most drivers who get told they will get £1 per hour more

Somehow I don’t think that will ever happen!
An Electrician/Plumber etc all use their OWN tools!!!
What tools does a truck driver use??
Why can’t every factory/service/construction worker in the country not opt for SE/Ltd and save themselves a fortune in tax/NI etc!!!

Be prepared to be [zb] over in the future. Self Employed drivers are being cracked down on because they and their employer are breaking the law.
If you dont own your own truck or hold your own operators licence, as far as Im concerned you are NOT self employed as you are using employer equipment, employer operating licence and I bet you wont be paying for your own diesel.
It is a huge fiddle propogated by agencies and scumbag hauliers who dont want to pay holiday, sick pay, NI, tax and employment rights.
More fool you mate. It will bite you in the arse as you have zero commitments from any company. They can drop you in a heartbeat.
That’s only as far as YOUR concerned yes it is getting harder and margins are tighter. But it not all as black and white and is portrayed by the arm chair lawyers on here if you want proper advice go see an independent financial advisor or an accountant
When I stated that HMRCs. view that a self employed driver should have his own vehicle, that wasn’t me being an armchair lawyer, it was a direct quote from a seminar I went to at Backhouse Jones, who are one of the best known haulage lawyers about. I wouldn’t call them armchair
Hi guys thought I’d post in here as I have a job interview tomorrow, need some help I work for a food retailer 38 hours a week contract shelf stacking now I have just got my class 1 and I have a interview tomorrow for a different retail company to work there on my days of so I can gain experience the only thing is they told me shift can be 12 hours long pay is 142pound per shift but it is via self employed with an agency, I don’t know the first thing about paying my own taxes and NI and that so just a bit confused any advice would really help thanks

And as I also said the op would be better getting professional advice instead of asking on here

I don’t want to go self employed but if that’s what I have to do to get myself in there and can do correctky and lawfully then I’ll do it.
But you can’t. The position doesn’t qualify as self employed no matter what the guy says.
Hopefully all goes to plan and they can offer me full time job with all the perks etc when everything picks up.
Why would they offer you a full time job which would mean a 12% rise in the cost of employing you through the workplace pension and employers NI they’d have to pay? He’s already said that 1% that the workplace pension would be is too much.
If you think things are going to pick up for petrol tanker drivers then you’ve not been paying much attention. Internal combustion engines are now on the slow decline to their eventual outlawing in 2040. Yes that is right, in just over 23 years it will be illegal to sell a new car in the UK with a petrol or diesel engine. Just how much in demand do you think petrol tanker drivers will be in the years running up to this date as more and more people shift over to electric?
Best thing is for the O/P to just give it a go if that’s what he wants.
As long as he puts aside enough to pay his tax and N.I then what’s the problem?
If the HMRC don’t like it then what’s the worse that can happen? he’s not exactly going to go to prison or even court, all they can do is tell him to stop, then he goes back to his employer and puts the problem at their feet, if they want to keep a good driver then they’ll find a way to sort it out.
Conor:

Whatever makes you think that? The Government’s stated aim is to end sales conventional petrol/diesel engined cars by 2040. Hybrids (both plug-in and standalone types) will continue to be sold for years afterwards.

I think that’s scare mongering a bit. Come 2040 there will still be plenty of fossil fuel vehicles on the road. And for a long time after to boot.

That’s one interpretation of what’s happening. The other is that you’re being employed casually by the haulage companies, and the corporate complexity is merely in place to disguise the essential relationship of employment, rather than being the trappings of a relationship that is different from employment.
It’s no different to an electrician, bricklayer, plasterer etc. HGV driving is no different.
The construction industry seems to be a class of its own, although most tradesmen genuinely do have trade tools, work vans and equipment.
The difference with non-owner drivers is that the essence of their role is to operate their employer’s vehicle under the instruction of the employer. Only a fool at the wheel pretends he is in charge of a small business.
For HMRC to outlaw this practice they would have to abolish employment agencies.
Somehow I don’t think that will ever happen!
Employment agencies were around long before this confusion about self-employment. Hence their name!

Ok I won’t go for it because in 23 YEARS It will be illegal to sell a new car in uk with a petrol or Diesel engine. LOL
I’m 29, I want to go from £11.50 an hour to £18.50 with this new job. You work it out.
Things change all the time. Can’t not better myself because somethings changing in 23 years. Mad man
A rather dodgy sounding set up that promises lots but, in reality could deliver nothing.
Setting up as Ltd which really isn’t as easy as clicking three or four check boxes on a computer screen.
Reading responses from the greater number on here who don’t reccomend you do it.
Reading yet another debate (do a search here about Ltd comapny) about the legalities and technicalities of Ltd company status.
our survey said eh-uh
There’s nothing dodgy about it. Every company starts from some where. Start small and expand. We’ll just have to wait and see of the outcome. I’ll keep everyone updated.
