Hope someone can help with this, when my emplyer downloaded my Digi Card he noticed I had driven on my rest day - which I had, but it was not a company vehicle and it was only for an hour and I was not paid for it, he has asked me for an explanation - do I need to tell him or am I within my rights to refuse as I have not broken any driving rules and regs regarding time off driving limits . And surley it would be for VOSA to deal with any wrong doing.

Does rest day mean anything? If you drove you didn’t rest.
You may also have to tell him so he can add the working time into your RTD/WTD log, although VOSA haven’t prosecuted anyone yet, there will eventually be “The first one”

Just another thought, you may have signed a contract that prohibits you from driving for anyone else or doing other work.

He has a responsibility to ensure the rules are being complied with so needs any information that might affect that, especially if it has a consequence for your weekly rest period. The fact it wasn’t a company vehicle, it was only for a short period or the fact you didn’t get paid is irrelevant. There is very little these days that doesn’t count toward the various totals and limits so he needs to know if what you did has an impact on the regulations otherwise it he could also be in trouble with VOSA.
If you did it on Sunday for instance it could prevent you being able to work for an employer on the following Saturday. If it meant you had a reduced weekly rest you will need a full one next weekend . Your employer needs to know these things so he doesn’t schedule work that will mean you then fall foul of the rules.
As wheelnut says, what does your contract say about driving for anyone else?

You should tell your current employer, if it’s digi he will see it anyway.
Cheers for the input everyone, I know I haven’t broken any Hours regulation regarding the WTD, but see your point regarding the fact that he needs to know if he/I have to reduce my hours, I dont see anything on my contract that says I cannot drive for anyone else, Mr B yes good point about driving assesments on your day off - but then its the drivers responsibility to keep to the rules and regs !!

Don’t worry about the WTD. The bigger concern in this situation, and where you are more likely to run into problems is the tacho rules.

Sorry for hijacking the thread if it was an assessment drive would it mess up the weekly rest period?
Yes, if it was during your rest period. If it was after you have completed the required hours of rest it would be the start of your new week, so could impact what you can do for your employer toward the end of the week for instance.
