Recording my time when not in vehicle?

Hi all,

hope I’ve posted this in the correct forum?

I am not driving this week because of personal issues so my boss has hired an agency driver! I am in the warehouse for this week, I do a daily job sheet & clock in & out each day. Is this enough as long as the law stands? As I was told all working time/ rest time must be recorded on the digi card? But as the vehicle is out with another driver how do I record my time when the vehicle is returned?

If you are not driving at all under EU rules this week, 00:00 Monday - 24:00 Sunday, then as far as the EU rules go you do not need to fill out charts or make manual entries on the digi card for you work in the warehouse. You only have to do that for days you work but don’t drive in a week where you do some driving.

The vehicle came back on Friday, I had to nip to a storage unit so I used my card, I did a print out & put a written entry on the back explaining reason for no print outs from Mon-Thurs. Will that be legal?

I have another query on POA, I got to my first drop this morning at 7.30 the crew who were unloading me were due at 8.30. I put my tacho on break till 8.00 then got a call from the crew that they were going to arrive at 9-9.30. I then put my tacho on POA until they arrived at 9.30. I had only driven 1.25 hrs. But when I checked my hrs driven on the tacho my driving time had gone back to zero? I only had 30mins rest in 1.25hrs so surely it should’nt have inc POA as part of my 45 MIN break? I got my other drops off & then had another 30 mins break on 4 hrs driving on my own countdown timer. Giving a total of 1hr break in 4hrs + 1.5.hrs POA is this legal?

If you’ve driven to EU regulations in the week you need to make records for the days this week that you worked but did not drive.
The records for the none driving days just need to show start and finish times, date and your signature, no need to keep exact records of breaks ec’t.

The digital tachograph wrongly counts POA as break and will reset the driving time after 45 minutes of POA, this has been a problem for quite a few people but you did the right thing in keeping track of the time and having the breaks regardless of the tachograph being reset.

The law requires you to have the break before exceeding 4 1/2 hours driving even if the tachograph disagrees, it’s one of the reasons some people prefer to use break rather than POA, less room for error :wink:

You’d think they would make the digi tacho to work, & sort teething probs out? They were designing it for long enough!

if you knew at 7.30 that they wouldn’t be there for an hour and when they phoned you later you still knew they wouldn’t be there your situation hadn’t changed?
either put it on break for all the time or on POA for all the time? I’m not sure which one but i don’t see where your situation changed

i get that bit neil, what i meant was why change as the situation didn’t change as i don’t understand when its supposed to be used :blush: is POA when you know how long you’ll be waiting or you don’t :blush: :blush:

When you know, by being told or by experience, how long you will be waiting.

if i have a booking for 8 and i know i can’t get in early but arrive at 7 thats an hour of POA? but available for what? i would put it on break and jump on the bunk :laughing:

I’ve only ever used it once by accident. From tomorrow that will change as I start my new job which is double manning so while my card is in the second slot I’ll be recording about 4 hours POA per shift.

In answer to the question? I put my tacho on break to have a break as I’d driven 1.25 hrs. I then put it on POA for the rest of the time, initially only another 30 mins but then turned into 1.5.hrs. I too find it confusing but slowly getting to know the ins & outs. Thanks for all the replies!!!
