Grr. Dammit. Thought this non-event would go away. Sorry to hear it’s resurfaced. Seems like conflicting advice from djw & Mike-C who both have valid views IMO. I don’t know what to do, though a brief would probably be useful (with the inevitable expense that comes with the perhaps unnecessary advice). I know it’s no consolation, but on this week’s Traffic Cops, a woman driver ran someone down killing them, left the scene and subsequently received no admonishment whatsoever:- the victim of this hit and run was a drunken cyclist without lights at night on a dual carriageway though.
As for the other side’s evidence, I don’t think they have the slightest obligation to disclose anything at this stage. Go careful!

Got a letter today from Kent to say it had been adjourned again until a fortnight. Good thing I didn’t go as I guess they wouldn’t reimburse me.
The reason given was… NO CPS FILE.
They also have dropped the major charges and left me with…
Failing to stop for an accident. And failing to report an accident.
Seems to me like they are clutching at straws.
so, they have dropped all the original charges and come up with another one without informing you?
i would take the day off work to attend court, and if you are found not guilty, you ‘should’ be able to claim your loss of earnings and a proportion towards your travel costs
I would certainly goto court next time with legal support because you don’t want to be convicted in your precence. Do you still have those other points on your licence then? Was that a DR, DD or IN? Either way, a fair whack of points plus this new thing could push you over the edge, especially after you have worked so hard for it!!!
So yeah, goto court, take legal, get them to drop it etc.
Might be best and cheaper to find a solrs local to the court etc.

You’ve been very lucky here so far. Even with a half baked prosecution case if you do not turn up they can, and pretty much will find you guilty in your absense. Its pretty much a simple paperwork excersise for them. If you had attended the court and they had no CPS papers you could of insisted the case go ahead and was not adjourned as it had already been once before, the prosecution had long enough to get their act together and you’ve travelled to the court at time and expense to yourself. What would have hapened here is that the magistrates would of ordered the prosecution to go ahead, and without the paperwork they couldn’t. So they would offer no evidence at this time and it would of been thrown out, never to reappear. I’ll watch this closeley to see what happens to you. I’m not having a go at you but how did you think it might go if you didn’t attend? Did you think they’d read your submission and the CPS submission and somehow believe you and find you not guilty? If you want to contest it you need to make getting to the court a 100% priority.

Just shows it was someone trying it on to get the car fixed that they probably damaged themselves and thought seeing a lorry in the street was a perfect chance to try to blame someone else to save the insurance claim ,
