Yes it was 18t lorry. I had heads up from agency a fortnight ago. NIP lists offences at 3pm 07/12/11Check your tacho’s again…at that time on that date, was the truck stationary or moving?
Just checked. Stationary from 14.50 to 15.15 on other work. That will have been when unloading. Analogue tacho btw
You need more information about the alleged offence then, maybe contact the police force concerned and explain that whilst it looks like you might have been the driver, the truck was stationary at the time of the alleged offence so need more information before you can positively put yourself forward.

From 24 September 2007 the definitions were updated. For careless driving it is still necessary to show that your driving fell below that expected of a competent driver, but they specifically look at the circumstances surrounding the offence and overall that you either knew or should have known of. For inconsiderate driving they have to show that someone was actually inconvenienced.
Defences to Careless Driving
These vary from showing that your actions were reasonable in the circumstances to showing another party may have been at fault.
Just keep us up to speed with this, it sounds completely OTT. I would say your actions were completely reasonable and in line with what would be expected from a person making a delivery in that location, I can’t see this one sticking.
This seems a bit much so defiantly let us know what happens especially as u can’t recall any instance that would incur dangerous driving mabe a resident has a grudge against who u were delivering too and trying to make trouble I hope u sort it out ,

I’m confused. If you were parked and out of the vehicle doing a delivery how can they charge you with DRIVING offences? The definition of driving for the Road Traffic Act is being at the controls of the vehicle, whether it is moving or not. If your arse wasn’t in the driver’s seat at 15:00 you weren’t driving surely?
Not listed in the OPs selection … and certainly not actually driving so got me wondering if they have listed the wrong offence(s) if he was not in the seat

I definitely was not in the drivers seat at 15.00. More likely to have had both hands underneath a sideboard while helping my drivers mate swivel it rounds a tight entrance hallway

Well, they will have to provide some sort of evidence, when you know what that evidence is, it will be time to plan any defence. Since you were quite plainly stationary at the time I would say you are on fairly firm ground to start off with.

Would the TC be inviting the driver for interview if they were prosecuted for any of those offences?If they do I can only say as I see it.
I have no recollection of any incident occurring
And if the police do take a statement then stick to it, don’t say or admit to anything and let it be known you’ll fight it all the way.
