My VOSA complaint

The police and VOSA will always go for the easy options, a clapped out truck with a foreign reg would involve far too much paperwork, not to mention language problems. Far easier to go for a UK registered truck where all the info can be pulled up on a computer. Lets face it, if some stormtrooper wants to find a fault, he will, however trivial (even a table on the dash, or a non existant bulge on a tyre :open_mouth: ) ).

No,you could lose your licenceand your insurance has to be up to date .If it is your land and the general public has access then you have a duty of care to them.

I hope my colleagues who go on about having enforcement powers read this thread. I, for one, am happy to perform an assistance role. I can see all the goodwill that we are slowly building up with the professional drivers go by the way side. I don’t want an enforcement role, been there, done that, got the spit in the face to prove it :open_mouth:

No, this is just some ordinary “maluch”, it just drifts on the bend while this picture was made.

Funnily enough there was a news item about this very recently. The owners of Birkenhead docks refused VOSA permission to come in the dock and check/inspect freight vehicles.

The point boils down to one thing and one thing only

Who pays for the maintainance of the road?

If it’s the Terminal Owner then they have to grant Vosa Permission to carry out checks but then again, I suppose Vosa could put the legislation into action that they use for any other operator which allows them access to the premises with 7 days? Notice.

If the Roads are maintained by the local authority then Vosa dont need any permission as its public roads despite being on private land.

Quite possible but this was in France. I was picking up an unaccompanied trailer from the trailer park in Calais.

I have an opposite opinion but agree about the Traffic Commisionar being able to mete out his or her own justice.

Recently in my local paper there were several court cases involving drivers with an overload. There were probably 7 or 8 cases and each one had a massively different fine and reason for it.

When I read the cases It seemed the bigger the truck, the bigger the fine where in reality the 7.5 tonner is more dangerous with a 500kg overload than a 40 tonner being 2 tonne overloaded. These senile old magistrates who are on life support should be given early retirement or a swiss pill.

Maybe it is time to have a single specialist court for the transport industry.

As youve got a question mark there Davey I can answer your question. VOSA do not need ‘permission’ to enter premises. We can enter operators premises at any reasonable time and no notice is required. This is of course related to gaining possible evidence, impoundings etc etc. Operators visits in the course of licencing etc are obviously booked in advance.

I dont think Ive had too much flak yet and if I do receive some Ive got broad enough shoulders to cope. Its very interesting to see peoples different attitudes on here and all helps with the training!

Ive come across ‘jobsworths’ over the years…security guards, traffic wardens et al. I intend on keeping a common sense approach to enforcement. Ive been educating a few drivers and they seem most appreciative of the chance to get things right.

I will also repeat that my colleagues in my area are more than likely to try and work through the problem rather than slap a meaningless prohibition on. That is not to say that they do not punish drivers that are clearly running bent and will possibly cause carnage on the roads. Then they take great pleasure in getting that driver off the road becuase its about ROAD SAFETY. Drivers can moan all they like but how many times have you read yet again about another family being killed by a rogue driver. I suppose it can be all too easy to become very cynical and assume all drivers are doing something somewhere, but in my eyes you are innocent until proven otherwise. If you arent innocent then watch out. Simple.
