MOT expired ......

yes an MOT is only good the moment the motor is tested…believe me I worked very briefly for a fairly large midland based company as an outreach driver .When I brought my motor in to the main yard for an MOT it received a new set of tyres(on rims)…passed MOT back to yard and old set put back on …trailers got the same treatment… :frowning:

Those quoting fines (£1000 and £60 have been mentioned) - where do you get your information?

I checked the Enforcement Sanctions Policy and there’s no fixed penalty. It’s a ‘FUE’ - which is Follow Up Enquiry and ‘MSI’ - which is Most Serious Infringement. These are aimed at the operator and not the driver.

Maybe there’s something I don’t know but as far as I am aware the responsibility is with the operator

Do you fill in a OPs 13 checklist every morning or something like that?if so I’ll think you’ll find it asks in there if the vehicle/trailer has a current MOT so it isn’t “nothing to do with you” and DVSA certainly won’t let you tell them that if they pull you over.

I’m pretty sure the op’s checklist will be no where near the standard of a ops 13 form.

We have to fill in a OPs13 every morning and at end of shift,always assumed it was standard for all companies tbh

It is not legally compulsory to fill out anything to say that you have done your checks. I know there was a massive crackdown on filling out ops 13s a few months ago but they are still meaningless in a practical sense. Just because you ticked the boxes doesn’t mean you did the checks but your signature shifts the blame to you without question. That’s all it is for!

I speak from experience. I was given my trailer on the 4th of October and spotted the out of date MOT disc before I had even hooked up. Who had taken it out on the previous days after ticking that box for that trailer?

Rubbish - there is not and never has been the equivalent of a trailer test disc (showing test certificate expiry date) for rigids or tractor units. “Ministry plates” (required to be displayed in the cab) are normally a once-only issue and don’t have expiry dates.

So yes, you are wrong (but not because of any change in the law).

Ok so the offending unit went for mot test today … Ok it passed but mid test one or more prop shaft bolts were found be loose :unamused: ( the tester allowed them to be tightened, then passed it )

A fairly elderly trailer that was tested at the same time failed on brakes , in fact a couple of new brake chambers had been fitted , some fittings or bolts was found to be loose on them :unamused:

I’m not really sure how the chimps in the workshop still have a job

Well it’s being having inspections periodically , I can’t say they’ve been done properly tho , I’m no expert but I’m guessing it should take more than ten mins and actually involve the truck being jacked up :unamused: Done 98,000km this year and no service or even oil change :cry:
As for trailer inspections well I presume that means actually getting underneath it oh and actuallyhooking up to a unit , :exclamation:

2 Hour for a Trailer,without repair of anything
6 Hour for Lorry,without any repair (not just running with a Hammer around)

It probably went for a tacho calibration - unless your place has its own rollers - so in fairness they may not have been responsible for the propshaft bolt, the tester will have probably known this too.

£1000 is the max if it goes to court (and it is income related).

£60 is well out of date.

A Fixed Penalty for no MOT is now £100.
