It does, it clearly shows in the regs that breaks interrupt periods of driving so by definition you cannot have a break that counts toward the required breaks before you have done any driving. All the talk of breaks in the EU driver’s regs is in relation to 4.5 hours of driving, so while you can have a break near the start of the shift you cannot count it toward the required 45 minutes for 4.5 hours of driving.

After a driving period of four and a half hours a driver shall
take an uninterrupted break of not less than 45 minutes,
unless he takes a rest period.
This break may be replaced by a break of at least 15 minutes
followed by a break of at least 30 minutes each distributed
over the period in such a way as to comply with the provisions
of the first paragraph.
OK thanks for that Del, but I see no minimum time so after one minute technically you are interuppting the driving period so why don’t they state a minimum I can see where all the confusion comes, could you imagine the kerfuffle if office workers had the same sort of regs as we do,
Type 2569 words then take a five minute break or read 8968 words and take a 15 min break. If I was in charge of this I would rewrite the ■■■■ lot and simplify it so even a monkey could understand it
cos that would make it that you must drive for a set time, there could be done for safety that you have been forced to drive for a set time before a break was allowed and there would never do that

Back on the trucks for a few months now. I couldn’t stand having a cargo that talks and moans when THEIR case isn’t the first one out the locker etc etc. I left before I ended up in jail for battering a granny to death
