Long story do i take them to court?

why do you people bite to these posts, if the op hasn’t got the sense to manage his own time, wtf is he driving for a living for, doesn’t he know how life works,?

Personally, I’d have refused to leave the yard on that job, but if I did, I’d have been leaving the other premesis with enough time to return to base under my 15hr spread.

Remember, we’re only supposed to do 13hrs anyway - only lol…

Once at Maritime, I got sent round to Freightliner, only 45 seconds from the depot, was in my last hour of 15hr spread, 30 mins before time ran out, I rang to see if they could speak to someone to get a shufty on, 20 mins before I rang again, 10 mins before I ran out of time I rang up to notify them that I was returning without the box. It wasn’t a discussion, just polite to notify them so they can make alternate arrangements.

If you had mate able to pick you up the truck should’ve sat in the layby overnight and you sat at home in morning until they picked you up.
They shafted you but I don’t see you have a case.

Don’t burn bridges, put it down to a bad day and move on :slight_smile:

So, if you had a sleeper cab your disabled wife wouldnt have mattered. Get a life.

Why not just leave the wagon in a field somewhere and get one of your so called “friends” to pick you up.

next day ops manager rang me to say " i take it youre handing in your notice then?" i said " after the way you treated me what do you think?"they invited me in for a chat and said i could take as long as i like to think about it. theyve admitted they was in the wrong and said if i didnt come back them there was always a job for me there.
in the meantime i`ve phoned one of my past employers and the md is coming round to my house for a cupppa and a chat as i left the company on good terms so i am lucky in that sense. however a few people have said to me take the last firm to court for breech of contract

ive looked at a few solicitors that deal with employment issues and they shouldve made sure they got me back to the yard or to a hotel

i have full copys of my run sheet and defect sheet for that ay also

should i just let it rest and get on with getting my old job back or should i contact the solicitors to get a case together?

You don’t have any sort of claim. Forget it. Move on. Enjoy life.

let it rest mate,youve got a new job/old job,not worth getting yourself wound up about it,i wouldnt listen too much to other drivers[take them to court],if you needed anyone too back you up with a bit of info on what goes on at that firm theyd be nowhere to be seen,move on mate

When a daily rest is taken, this may be taken in a vehicle, as long as it has suitable sleeping facilities and is stationary.

Depends if you’re old school enough to consider sleeping over the seats “suitable sleeping facilities” :stuck_out_tongue:

You don’t want to be banging the drum if you (YOU) have done an 18 hour shift mate. You could be prosecuted for that for the next 6 months if you get stopped, saying something along the lines of, “I was left with no choice because there was no bunk in the cab” isn’t much of a defence. Also trying to spread the blame may get your old firm in to trouble but you will still be in the frame.

As I’m sure you realise now, you should have refused to go in the first place but I appreciate the urge to try and help out can be strong for some folks, me included.

Just chalk it up and move on.
