Quick question guys as we were having a debate over this at work.
A driver is leaving tomorrow and has been asked to hand in all his tachos tomorrow evening.
He is wanting to hang on to them as he is expecting to start a new driving job in a weeks time and obviously wants to make sure he has his 28 days worth of tachos with him.
Is he correct to do so and if the firm insist on him handing them in, where does he stand if stopped by Vosa just after he starts his new job.
Cheers
Mark

He has to carry his cards for the present day and the previous 28 calendar days, he has to then send them back to his previous employer after this time.
The problem with this is the company may hold onto his money until he has done so, they wrong but some companies are like that.
A written promise should all be that is needed, sign here. I promise to return all issued equipment and tachograph records on or before //****

You missed the point.
The photocopies are not for vosa and just so the guy can get paid. He then sends them back to the company after 28 days.

Photocopies are no good to the company either. They need the originals after the driver no longer has to carry them They might delay his final payment until they have the originals.

He does by law.
Just like when working via agency the company wants your tacho and they try to give you the photocopy.
idiot company. I rest my case.

the agency have no right to the original tachos, they can have a photocopy if they require.
It is a legal requirement that the driver will carry 28 days cards and then hand them to The Vehicle Operator, who must check them & store them securely for 12 months, 24months if using them for the RTD

Yes I KNOW.
His company has no right to his old tacho`s til after 28 days.
Going round in circles me thinks.

We aren’t you are. in fairness we both answered the question within a minute of each other, but then you mentioned photocopies and spoiled your answer. But you have edited your answer so I don’t know what you wrote originally because I was still pushing the submit button
Thanks for the advice guys.
All resolved amicably, our man has kept his charts and says he will drop them in once the appropriate time has passed.
