No, drivers do not get infringements for recording only the minimum legally required breaks. But they might get one if they e.g. took 16 (or more) minutes for their first break and then relied on the tacho to tell them when they had taken sufficient second break to total 45 minutes…

On mine it won’t register the full 45 until at least 30 minutes has past, that is if I took a 15 before this.

That’s because yours is a more recent tacho. When digi tachos were first introduced, it was perfectly legal to split your 45 minutes any way you liked as long as each break was at least 15 minutes (so 30 + 15 was permissible, 20 + 25, 16 + 29 or even 15 + 15 + 15). These versions were still being fitted in new vehicles up until 2010 and if you have one in the vehicle you are using it will indicate that a full 45 minutes has been recorded even though you have not complied with the Regs.

Like this. Guaranteed infringement if you drove off but your tacho is saying it’s OK. Because in the past, it was.

The first generation Stoneridge digi units would allow you to drive after completing a total of 45 minutes rest. The problem was if your first break was 20 minutes it would happily accept 25 to complete your 45.

Wasn’t just Stoneridge, they all did that and the regulations used to allow that. Any combination of 2 or 3 breaks as long as the minimum was 15 minutes was legal for taking a 45.
