Got pulled by Vosa today

No ,no paperwork at all .Having gone through my hours again today i can see what they did and to be fair they appear to have gone above and beyond to make my hours legal ,from what i can tell they have tagged a 2 day rest period from one week onto the next week(which the guy did explain ) meaning i did not work too many hours back to back over 2 weeks ,don’t know if that makes any sense but when it is layed out over a 28 day period on a piece of paper it seems clear to me

I don’t think you are allowed to sit in the cab and “read a newspaper” or “be told to move off” whilst they are checking your vehicle, so technically you are on “other work” when ■■■■■■■ with VOSA checks because “you are not free to dispense with your time as you see fit” nor “free to dispatch without further delay” whilst the checks are being carried out.

The truck i was driving is a bit of a wrecker ,it was pulled 2 weeks ago for a leaky ram on the taillift and given a notice to repair so it was in Sandy lane the day before i got pulled in it at which time they decided to do the MOT which was nearly due so it may be the truck as much as the company .The copper that took me in did say that he pulled the truck based on it’s looks

I was thinking the same, but let’s leave them to it, they know everything don’t forget.

Bet they get fed if they’re at Tesco for more than 3hrs too, manager takes them to the local beefeater in his car and pays for food and beer :wink:

But do they book the time spent travelling in the manager’s car as POA or Break?

The last time that I had the pleasure of their company they gave me a document to show that the motor had been checked,this was valid for 6 weeks IIRC.

Just out of curiosity, what mode did you have your tacho on while they had you pulled up for 90 mins??

If it was me I’d have had it on POA, would that have been right??

i’v tried that and very nearly got fined for it, correct mode is other work i was told

got pulled at SLEAFORD about 6 weeks ago , with a 13 plate truck the 2 young lets call them keen operatives thought it was there christmas day untill an older and wiser member of there staff pointed out that the truck was stgo cat 3 and M,O,T exempt , i was waved on my way with a have a nice day sir, i then asked if they wouldnt mind goimg and getting my ■■■■■■ driver who being very observant hadnt noticed i had been pulled, a quick coffee and ■■■ and i was on my way causing chaos, i found them very helpfull lol

My driver was pulled a couple of weeks ago on “The Highway” (E. London) he said they were very nice & helpful they wanted to be his new “best friends” they asked about driver CPC (he told them just done my 35 hrs)then was sent on his way! was given a no infringements document.

any 13 plate vehicle is mot exempt as they don’t have the first mot until they are 1 yr old :smiley:

If you are just sitting wating (reading the paper/sleeping/eating etc) while they do their stuff, you could legitimately put the tacho on Break. If you are inter-acting with the inspectors (e.g. answering their questions, producing documents, switching the lights on/off, digging out those paper charts, printouts etc) then it would have to be Other Work. As you don’t know in advance how long you will be waiting (unless you’ve been stopped several times recently, so you know more-or-less how long it takes), POA is not really an option even if you are not inter-acting with the inspectors.

Years ago i had just finished my run in Aberdeen and i was heading back to Glasgow, so i knew there was place just outside of Aberdeen that vosa used to pull in trucks to check them but i decided to stop before it and have my 45 min break which would leave me good time to get back to Glasgow and finish early…

finished my break and headed off and low and behold the police were there pulling in trucks and the guy before me was let past but they pulled me in :frowning: …i sat in a queue for nearly 2 hours and when i got to the front the guy checked the operaters licence on the window then asked me if i was loaded which i wasnt then told me to go !!..i was raging as they held me up for all that time and didnt even check the truck properly !!..and i hit all the rush hour traffic in Dundee :imp:

You can have a break in a moving vehicle, as long as you’re not doing and work related task such as driving, map reading, navigating or brown-nosing the gaffer

any 13 plate vehicle is mot exempt as they don’t have the first mot until they are 1 yr old :smiley:

thats correct what i meant was the young lady opperative was typing my reg in her keypad and nothing was coming back it was explained that all vehicles when registered go on there system ,special types dont :unamused:

There is no problem with taking your Break in a moving vehicle (provided you are not doing any work, e.g. navigating).

I got stopped last week at the a52/a46 roundabout between Nottingham and Grantham, they checked tyres and lights, weren’t worried about tacho, and apart from commenting that one tyre would need changing soon (already noted on defect sheet), was told all ok, carry on. To quote Miles Jupp: ‘great bunch of lads’, in and out in about 5 minutes

They’re my favourite check point people :slight_smile: asked me last time if I worked Monday to Friday and let me go :slight_smile: had a living trailer on too so they could have caused hassle for me :slight_smile:
