Assuming you did other work, eg in the yard or office or warehouse, no. It’s recorded as “work other than driving” on one attestation form, and another to cover the weekly rest
But what about on the manual entry? You physically can’t put more than a fortnight of working and break times on.
The Attestation Form takes the place of an actual physical manual entry
Ah OK great, so it doesn’t matter what is inputted on the manual entry (as long as it avoids infringements)?
So would you use rest or “?” when performing the manual entry?
I haven’t read that much detail in to it.
It could be that it’s not a RM reg and is actual law.
I’ll get to it eventually.
Surely the law would offer a little more flexibility where times are measured EITHER:
0000 to 0000
or
1200 to 1200
The law specifies 24hr and 45hr weekly rests. Nothing at all about midnight or midday.
The quick guide is linked above and again here.
Work is other work.
Driving is driving.
ANY work I do, is work and would be recorded as such.
My other work is not a doss, I take it quite seriously.
Yesterday’s shift:
- Start -0900
- Service use in bed til 0930, motivate to bathe
- Service user in bath until 1045 - offer motivation to exit tub from 1000
- Service user dresses self, tidies room with prompt, makes coffee
- I prompt teeth, shave, deodorant
- Quiet morning watching tv until dropping him to parents at 1400
- Nap on sofa til service user returns at 1900
- Prompt pjs, make supper, watch tv until bedtime at 2100
- 2100 teeth, bed with Bond movie
- Wait for shift end at 2300
- Go home to bed to return at 0700 to take care of house chores and handover.
This is arguably work, lol
Erm… Sounds about right but I’m not sure we’re not going round in circles here: we need to provide FULL RECORDS for ALL ACTIVITIES, so…
We don’t use “?” at all, as this is is says “I can’t tell you what I was doing” because it means "unknown activity
The tachograph requires something and if the record is being kept elsewhere, then yes ? is correct.
If you simply do not perform a manual entry then the time when the card was out would default to ?.
(Of course it may depend on the tachograph unit and the way it prompts you.)
Yes, that’s my thinking. Anything else would be an incorrect record on the digicard.
If you want to use “?” that’s your choice, but if you do, be aware that it is likely to result in automatic enrolement on DVSA’s “training via the wallet” scheme.
@zac_a You are completely missing the point. You still need to select a mode for the time when the card was out. Effectively ? is the only option. Of course you need a compliant record held elsewhere as well.
No I’m not missing any point.
-
Card out over weekend - standard manual entry for “rest” (using bed symbol), assuming that driver was, as we would expect, on weekly rest
-
Card out while on holiday or off sick, again a standard manual entry for that period, indicating “rest” (using bed symbol)
-
Occasional drivers, card out for longer periods eg two weeks, can do a standard ME, or complete an Attestation Form WHICH OFFICIALLY TAKES THE PLACE OF A MANUAL ENTRY
-
Occasional drivers, card out for periods over 28 days, Attestation form to cover 28 days
For the last time (sick of repeating this), “?” should no longer be used as it indicates “unknown activity” which does not fulfill DVSA’s requirements for “full records of all activities” as required by (EU) 2020/1054, which amends (EC) 561/2006
Ha ha ha this is getting silly now.
Even if the attestation form replaces the manual entry, the manual entry still has to be done.
So what mode do you use for the time recorded on the attestation form when performing your manual entry?
I’ve had enough of explaining the same thing over and over again, it seems to me you are deliberately not understanding plain English. Do whatever you want to do, it’s no skin off my nose.
To be honest, the attestation form may be a valid solution under certain circumstances if working at the same place and there is somebody there used to using them. It isn’t even the default for domestic driving, just something that can be used.
Using the ? symbol and keeping a record of activities in blocks is the correct action. In weeks where no in-scope driving is done, effectively it amounts to blocks of other work and blocks of weekly rest. Probably most people would use tachograph roll to do it.
For an agency guy, it is a two minute job and doesn’t require the signature of anyone else. An absolute no brainer.
Yep, that is what I have always done when I used to work full time non-driving.
I don’t have to worry about it now because all my paid time is on the digicard
