You don’t need the keys in your possession to be prosecuted for drink driving. The points to prove for the prosecution are;
‘driving or attempting to drive a mechanically propelled vehicle on a road or public place’
If you’re too rat arsed to realise the keys aren’t in the ignition yet you are going through the motions of trying to start the vehicle, that’s grounds for a successful prosecution.

The thing is they have to PROVE INTENT to drive… if your parked up in a layby at the side of a main road, or on the road in an industrial estate… then by the very nature of your parking, it could be seen as intent…
now if you were parked on PRIVATE land (truckpark/MSA/some companies yard) then its a different ball game, cos they would/should be doing motorhomers on private camp sites too!
You’ve been out drinking. A friend comes to pick you up from pub. On way home, your friend stops off at shop. He leaves key in ignition. You wait in passenger seat while he/she goes to shop. Copper walks up and sees you in passenger seat with keys in ignition, then arrests you.
work this one out, when i was younger a mate had a ford capri which he was doing up outside the house, he still lived with his mom and dad, one day they had a massive argument and he went out and got himself s/faced, found is way home but his parents had locked him out and after trying to kick door in and a bit of arguing with his parents he climbed in the car to get his head down, but a neighbour had called police who turn up and end up arresting my mate, eventually he was done for drunk in charge as he had the car keys on his house keys and was in the car, however the car had no engine and no real chance of going anywhere… even brakes were seized on…

I will mate. I agree, It really does need posting as it does sound a bit far fetched.
Out of interest, a friend of mine had an argument with his wife a few weeks ago, walked out of the house and sat in his car. Turned the ignition on and sat there listening to music. Presently, the Police drove past, saw him, bagged him and arrested him for being drunk in charge.
He turned up at court with a very well known and expensive lawyer. Minutes later the case was thrown out.

Agree with the above if you can afford it you will get away with most things. I for one had a barrister this I believe is the only reason I got off all them years ago. It was however pot luck as my lawyer was off the day of the case but his friend was a barrister who stepped in for my lawyer
There is no distance limit for drunk charge and if you are driving after drinking you must charge for that.But most of the time if there is no evidence you can easily get rid from all these legal actions. World Class solicitors

If that was the requirement for drink driving prosecution then there would never be a chance of overnighters getting breathalysed whilst in the bunk.
AFAIK the law isn’t about driving or attempting to drive but simply being in charge of the vehicle.
