If the card cannot be retrieved from the other vehicle it would come under the heading of a malfunctioning tachograph, in which case you would be allowed to continue the journey, the regulations say that “the employer shall have it repaired by an approved fitter or workshop, as soon as circumstances permit”.
“While the recording equipment is unserviceable or malfunctioning, drivers shall mark on the record sheet or sheets, or on a temporary sheet to be attached to the record sheet or to the driver card, on which he shall enter data enabling him to be identified (driver’s card number and/or name and/or driving licence number), including his signature, all information for the various periods of time which are no longer recorded or printed out correctly by the recording equipment”
The fact that you cannot retrieve the card from another tachograph would be the same as the card being lost/faulty, you may know where it is but you certainly can’t use it because of a faulty tachograph.

Rip the bloody thing out
The key had snapped, and tacho only comes on with ignition. I was bringing the replacement vehicle for trans-shipping and then wait for breakdown to turn up with key for the other vehicle. (Merc Atego)

yeah but you can just pill it out at 4 hours 28 mins if you are only ten or 15 mins from depot
just drive the last bit with no card

Unless I do an ANPR search and find you on a camera when you claim it was in the yard !!!
In reality, I WILL give you a ticket for driving without a Digicard, whereas running over 10 mins to 4 hr 40 I will just warn you.

What about if you break down and are provided with another vehicle, but can’t get your tacho out of the old one ? Is that possible ? (Snapped key, couldn’t turn ignition on to eject card scenario)
you can still eject the card with the ignition off, the only thing that doesn’t work is the backlight! The tacho does go to “sleep” but wakes up when you press any button and will operate normally!
Maybe a fault with my truck, but I cant eject my card with ignition off, I can press whatever I like, but it will only eject with the ignition on.
Nice one Traffic Rat, its not rocket science, taking the card out is a no no.
I have been pulled and given VOSA my print out’s with any infringement comments
on and find that honesty is the best policy, if I have ran out of time and its taken
10 minutes to find a suitable layby, (some nights you can pass layby’s for miles that are full)
I just do a print out and put the reason on it and no reasonable enforcement agent will
protest, as long as you are honest.
