If he can’t produce his licence, you can phone dvla BUT does that prove he is who he says he is on the phone etc?

I’d say no licence, no job. We can all lose a licence, but a replacement only takes a couple of weeks max.

You are well within your rights to sack him if he refuses to produce licence on request.

Also, sounds like he’s a [zb] worker anyway, in 6mths he’s trashed a car, failed to report it and been late twice?

Reading your first paragraph are you sure about that one fella as I was under the impression that DVLA could give licence details? Classes (C+E) etc

I’ve said he can phone the DVLA for a licence check - you have to have the driver there to confirm some details and say it’s ok for them to answer the companies questions. I’ve had it done a few times over the years. BUT, if you were using someone elses details, who’d know? At least with a photo licence it’s gotta look something like you.

i thought that the driver has to be preasent at the phone call dvla can not give you info unless the person is there but if the driver knows the address postcode drivers no it could be anyone

If you have access to the FSB - you can ask them about your rights to suspend or sack him
be carefull as its a legal nightmare - and he has soo many rights as an employee
I would write him a letter asking him to attned a meeting - a requiremnt of the meeting is the licence check
if he fails to attend or fails to bring his paper part you can the suspend him for failing to comply with a written request from his manager -
10 minutes later you can request him to attend a discipliary meeting - and then you can hear his side of the evidence - then you ask him to leave while you make a decision -
sacked - all done properly

Actually the police don’t have access to that database, I was informed this after being pulled by a copper in Norfolk whilst driving a Maritime contract wagon, because they didn’t know it was a Maritime wagon.

Maritime have a green light and rarely get pulled for anything.

I was stopped by a patrol car and they knew who was the registered keeper and that the car had valid insurance/ mot. They never gave me a producer, just three points and a 60 bloody quid fine :cry:

I cant afford to bet due to the cost of fuel an the vat increase but I would chance a pound on somebody on here knowing the co, tm an the driver. Juicy news travels fast, I dont think any driver would like his tm disscussing his employment issuus on here, how would you feel if you read this post and it was you that was being discussed, many a hot headed driver would bang him one… Managing staff is like being a bloody social worker, like I said before, listen an learn, an to be honest if a tm has gotta come on here seekin advice then he aint up to the job…

Quick and easy way of dealing with this.

Its bound to be in the contract “any other duties as may be required by the company”

The answer to this situation is this. Until he produces his licence then unfortunatly he can not continue driving. Tell him that he is on yard duties until he produces his licence. Get him to wash down trailers (wash out trailers if they are fridges)
Clean and tidy up the yard, litter picking, weeding anything. When he realises that he is under your watchfull eye all the time he will do one of 2 things

1/ he will walk…saves the minefield of employee’s rights etc
2/ he will produce his licence

Either way, next time round you will have no problems at licence check time.

If he was stopped by the police he would have to produce license within 7 ? days so should have been able to show you by now.
Beware, we had a non English driver from agency come to our place so licence check was lapsed/forgotten at 0600.Had accident at 0700,license was then checked for insurance claim - it was his brother’s license.Similar first name and photo.

Just a thought if he hasn’t got a license then he wouldn’t be insured either. In the previous accident wouldn’t the insurance issue have forced the matter?

My company does it every 3 months & i have no problem with it. I have nothing to hide so what does it matter??

These responses sum the whole job up for me :exclamation:
Any TM worth his salt would have this non - compliant driver outta the door sharpish before somebody gets hurt bad and you end up in the shheett for employing an unlicensed driver.

Also agree with LRM and WN but my recent experience has shown some guys seem quite happy to take trucks up and down the road without holding the appropriate entitlements :exclamation: :exclamation: And there seems to be as many willing to employ them :unamused: :unamused:
