been doing double manning recently and total working time is between 13-14 hours nightshift.
However on returning to base I was asked if I could take another unit out to the service department which would be another 40-50 minuits driving solo, now I said no, on my understanding that to shift change from double man to single man on the same shift contravines the working time or mobile workers directive in that the single man part of the shift exceeded the 10 hours working time rule.
Lets make it clear the boss didn’t argue with me at all and arranged another driver to do the job without any prejudice at all. Was I correct in this assumption though?.
It might not be because of the WTD you couldn’t do this, if you are double manning you might have clocked plenty of POA while the other guy was driving and the 10 hour night limit is only work, driving and other work. The 10-hour night time working limit applies to multi and single manning operations, you can’t get round it by multi manning the run, except for the fact is less likely you would reach 10 hours of work.
The problem might be be with the tacho regs if this extra trip took you beyond 15 hours duty time. You can go beyond 15 hours duty if multi-manning but for that two drivers would need to be present for all but the first hour of the shift. Easiest way would have been for both of you to take the unit to the service department.
