Defending a charge of speeding

Sadly for Harry I think that the ‘law makers’ have done their job more than thoroughly in the case of camera prosecutions.The number plate seems more than enough to convict any driver who’s unlucky enough to get caught by a gatso doing 36 mph on a road which is often ‘morally’ limited at a higher speed than that.

Incidentally, just a heads up, it’s the Gatso on the A44 at Chipping Norton, where the limit has recently been reduced from 40 to 30. .

It always seems more than a coincidence to me how cameras often seem to be placed on stretches of road where the limit is reduced from what it was in the past.There’s some well known ones locally which are on rural dual carriageways which were subect to a speed limit reduction from the national limit to 50 mph.However we’ve got no cameras in the established 30 mph limits in the built up areas.Did you mean that road in question there was subject to a limit reduction from the national limit to a 30■■.It would figure and would provide more ammunition for my view.

It should work if there is anything in between the camera and the motor vehicle, which obstructs the view of the motor vehicle in such a way that its make and colour are not discernable from the photos. Like a sodding great big trailer for example :wink:

If you have been Gatsoed then I am afraid that you have little chance of getting away with your henious criminal offence. I say this as a victim.I asked for the photos, my request was not granted as there was no person in the picture just the rear of the vehicle.

Was that before, or after you entered a plea ?

“They” aren’t required to provide evidence until you plead not guilty. They can’t refuse to provide once you’ve entered a plea. Bit of a catch 22 really.

I cant see this tactic working for overturning existing speeding convictions as you have effectively admitted your guilt when you take the points, uless you went to court and argued your innocence all the way though.

I was done by a scamera on the A9 near Blair Atholl at 04.10 The road had been dual carriageway then reduce to single the camera is sited on the down hill section of course.Well I just had to pay up after buying a book about avoiding fines and points,waste of money I.M.O.

Not quite following… Was it a dual which ended and then went to SC or a dual which had been reduced to one lane but still with a central barrier :question:

While it is a legal requirement to name the driver doing so doesn’t automatically mean they’ll get the points. For example, if the NIP has been served late (over 14 days to the RK) then the driver must still be named although the speeding charge can’t stand.

am not sure of the loop holes but am sure if you dont admit it you carnt incriminate yourself, ive been pulled over on my motorbike and they always ask you" do you no why i stopped you" the obvious thing to do is say no!! and they carnt do anythink am not getting into a moral argument of the rights and wrongs we all are guilty of speeding whether on purpose or not, but speed camera’s dont cut down accidents they fill pockets and drivers are an EASY target and were forever paying out. being an ex soldier i think in light of the current issues concerning our troops abroad and the recent baby p atrocity i think gettin off with a speeding ticket is fair game, by the way bringing back capital punishment for peado’s is a far bigger and better cause to follow than ripping off the average driver trying to earn a living to feed his already surpressed family. i wish harry all the luck whether he gets away with it is another thing, just to add i dont condone speeders but were only human and we make mistakes and as do the police.

If you tell them that your tachograph records show the vehicle as being parked at the time of the alleged offence they send you the photo`s straight away to re-enforce their case, but if you go to court there will not be any evidence offered at the first hearing only if you plead not guilty and go to trial, when the fine will definitely be increased.

They discriminate as moto bikes get thro a loophole no front plate !!!

I’ve driven that journey- Evesham to Sittingbourne- probably 300 times in the last nine years and the first time I got it wrong was the week after Thames Valley Police brought the speed limit down…

If we kick the government out then maybe we could raise the limit back to what it was before and all of those who’ve been nicked at under that can have their convictions quashed.
