Yeh i know it is too much, least he hasn’t done it at all this year.
I know what you mean about the devastation… it’s sad that when a driver from his company ditched his wagon in the snow, and vosa asked him why he was going so fast down a hill, fully loaded in a snow, he turned around and said ‘because our company don’t give us enough time’.
I just wish companies would realise how drivers feel, but it will never happen.
so your husbands company from the sounds of it may already known to VOSA if the driver came out with that daft reply red flag to a bull springs to mind and would love to hazard a guess what their OCRS score might be…so stand to reason then your husband may stand a good chance at being pulled for a routine, not suggesting in anyway your husband’s running bent but the amount of times you’ve said he’s had to go over his hours because they way the employers schedule his runs im not sure if vosa would class them as rare, like others have said just keep his head down and keep legal untl he finds a better job, its his licence/livlehood at risk.
as neil said the employers at the minute hold all the aces, if they loose a driver they can afford to have the attitude oh well ■■■■■ happens lets just just pick another one from the 100+ drivers on the waiting list and they’ll wash their hands of your hubby if he hits bother with the ministry…and ends up having tea and biscuits with the TC

haha yes he knows i have posted, he was the one who told me to try and find out… good job he doesn’t mind who i speak to
i don’t know what there score is, but they rarely get stop check from vosa, so i’m guessing they can’t really be being noticed by them, which is unfortunate in some ways, but good in others.
all we can hope for now is that he is able to get a job elsewhere, although the conditions of work may not be better, i doubt it can get much worse than this company!
I have a mate works for this company & he states that as with all hauliers they need their pound of flesh but he was informed that the job may entail N/O & they will pay them even 20 mins from depot, he has rung them to ask to be changed over but they have told him to overnite Book ex,s & run in next morn. Dont know if this is true but he says it is. Have also seen his tacho analysis which they have to sign for even a few minutes, he says they are very strict on Tacho infringements
Next time he’s out of time, 20 mins from his drop, just tell him to stop in a layby, ring them and tell them he’s out of time and having 9 hours off, that might make them run it a bit less close to the wind.
He never runs out of time before a drop, just on the way back to the yard. They hate drivers running out of time, but they still do it!!

If he has run out of driving hours but not working hours then he can have a LGV driver come out (who does have time available) with a car/van and do a driver swap back to the yard - perfectly legal as the driving in a vehicle under 3.5 tonnes counts as other work
It IS up to the driver entirely…The law states very clearly that a daily rest period is 11 hours…we all know that it can be reduced…i personally never reduce for the simple reason 11 is not even enough anyway…if a driver has an hour each way to travel home then by the time he`s eaten…got sorted etc…his rest period could be as little as 6 hours rest…is this good enough…NO its not
The other way i look at it is this…reduced rest of 9 hrs equates to 6 hrs a week so base this on £10 per hour and thats £60 a week…£240 a month…and just under £3000 a year…i for one are not giving that to my company coffers…each to their own…do what you will…

Your math is a bit arse about face, you aren’t giving it to the company, you are earning from it.
Taking a reduced daily rest means you can have a longer shift, 15 hours instead of 13. So say you reduce 3 times a week, could be more than 3 times but you used 3 so I will, by the maximum allowed that is 6 hours a week. Those hours will more than likely be overtime hours but even if it is only £10 per hour that is £60 a week x 48 weeks, a year minus holidays, equals £2880 per year extra a driver can earn. That’s a decent holiday, even after tax.
just sounds like the planners or company are trying it on. living 45 mins away from work dosent concern the company i had the same problems you have mentioned i refused to reduce unless it suits me or am tramping, if he is what they call a day man they are usually contracted to 12 hours per day, but its swings and roundabouts with us favours for favours, am sure he is probably feeling a little uncomfortable about telling the company he dosent want to reduce but if he dosent they will assume he is happy and keep doint it,
can’t he run out of time within walking distance from your house? he can then run into the yard in the morning.
is there a reason he dosn’t sleep in the truck at the yard?
i live about 10 minutes from the docks that i work out of. if i manage to get back i’ll probably go home, if i’m not going anywhere until say 8am. however if i am going at 3am, then there is no point going home.
