Been caught speeding

When I finally got a photocopy of tacho, I sent a letter with tacho telling them to check the flash time against speed trace on tacho and they replied along the lines of “tacho could be from another day and been doctored. You could go to court and risk x points and a heavy fine…” I couldn’t risk it but despite TM admitting I was “probably innocent” as I was fined I’d have to forfeit bonus as “we’re not paid to speed”…

This is EXACTLY how I got a speeding charge dropped. The CPS kept refusing to acknowledge my letters with a photocopy and an enlarged copy showing I wasn’t speeding. They took me to court and the magistrates took one look at my tacho and threw the case out. It helped one of the magistrates was an ex driver of some sort, he knew what he was looking at/for.

The guy from the CPS thought he was onto a winner when he said I had been doing 100 at one point and 80 past the camera. The smile was wiped off his face when both myself and the magistrate pointed out it was KPH.

All you need are those 2 wonderful words…Reasonable Doubt.

It helped I had a job in the morning with an exact pickup list. I was doing a school contract and couldn’t run early OR late.

It came as a bit of a shock to be in a trial as I thought I was only doing a preliminary pre hearing thingy.

Maybe in Scotland this will work, you send the form back unsigned. But they will send a police officer round your gaff to get you to sign the forms, you need to avoid the police for at least 6 months. If you can do this you may get away with it.

In England, if you just ignore the S172 request (usually a combined S172/NIP is issued), you will get done for ‘failure to furnish details’. 6 points and a much bigger fine.
Even if you havn’t recieved the NIP/S172 in the post, there is case law to support the courts view that if it was sent 1st class, it’s as good as delivered.

Good advice. It aint worth the hassle, especially if it was a company motor, you’l also involve them. Your first 3 is ■■■■ all.
Used to be you could blag it but those days are gone i reckon.
Couple of drivers i know got done in ford transits doing 80 in a 50 and they got it from the company as well as 600 quid and 6 points! I got an SP10 for doing 54 in a 40 back in 2008, 3 points and 60 quid. That was from those clever gatso’s that measure vehicle weight on a SC road, 60mph.

Did this, first 2 times it worked! Third time got done for failing to provide the required inf, 650.00 fine & 6 points!!!

So in your case it was a result as if you had a been honest all 3 times you would be currently sitting on 9 points :wink: :laughing:

got a reply today,35 to 42 mph and they will consider you for a speed awaeness course.i hope i can do the course.i will let you you know how i get on
