i am been invastagated by vosa for useing my traffic planners digi card .ihave owned up to this to the vosa. after trying to drop me in it my planner admited givin me the card’he asked me to do a job i said i couldnt as i had no hours left. so he offered me his card and i took it .i used the card over a three month period and then i called a end to it .i only doe it to help him out not for financial gain .after goin through my time sheets the vosa realises this.ihave been suspened from work and r faceing a disaplinery.iam waiting for a letter to go to court and to find out what i am gettin charged with .i know i have been stupid and i have only my self to blame. i stand to lose everything house etc do the tc take all this in to veiw as iam goin to have to go in front of them.vosa said it will go better for me as i fully cooperated.any advice appreciated
I’m afraid I can’t really give any advise other than you will just have to wait and see what happens, but I’m curious to know what happened to the planner who allowed you to use his card 
Is he also suspended from work and facing a meeting with the TC and possible court action ?
yes he has also been suspened .he has been caught out by the vosa after he tryed to cover himself .the vosa has told me he is in more bother than me

I wonder if he thinks it was all worth it now 
A couple of dodgy cards with the manager or fitters name is one thing, but a chipped card with a photo and 12 months data on it is a bit of a ■■■■ take

In Decembers edition of Truckstop news theres a ‘legal’ section, and it mentions an employers duty of care as regards driving over your hours. It may not be of use to you regarding the VOSA side of the investigation, but it could help you out with which direction to take your suspension and disciplinary. I’d suggest you go read it, you can get it online.
