You don’t need to have a 30 minute break for the 6 hour rule you need a 15 minute break

The rule is 15 mins before going more than 6 hours of WORK (not shift time)

As the RTWTD is not and has not been enforced for over 5 years then it’s up to you as to whether you worry about it or not

hi thanks but never had to use this law thing…right if i start at 12 midday say come 6pm (THATS 6 HRS SHIFT TIME) all i need is a 15 min break …so what happens if my shift finishes at say 10 pm (thats 10 hrs shift time) sorry to seem dumb but used to run from a to b …4 hrs driving bang it on its break then run from b to a then finish…also isnt it true that i gotto have a break of 15 mins first then 30 mins in my 4.5 driving limit…its not 30 mins first again sorry to be dumb bout it just making sure as had wee argue with fellow trucker bout this…cheers all

SHIFT time is not the issue
WORK time is the issue
What WORK (driving and other work) was done in the SHIFT?

If you have a split driving break it has to be 15 minutes then 30 minutes, it’s very important that you get it the right way round 15 then 30, otherwise you’re likely to get fined if you get stopped by VOSA and infringements of your employer even if you don’t get stopped.
Alternatively you could just have a 45 minute break before exceeding 4.5 hours driving

For the working time regulations you should not work over 6 hours without a break of at least 15 minutes, so if you worked 10 hours working time the 6 hour rule would only come into operation once.
If your working time is over 9 hours you should have a total of at least 45 minutes break/breaks but as the driving breaks count for the WTD and vice versa your driving break will probably take care of that if your daily driving time is over 4.5 hours.

The VOSA Guide GV262 may help.

thanks a lot for ure reply much clearer now had a read on few topics concerning wtd…again thanks for getting back to me much obliged cheers :stuck_out_tongue:

Doesn’t matter about the shift time, that isn’t what triggers breaks for the WTD. It’s the amount of work (driving and other work) in the shift that matters.

I do shift of about 8.5 - 9 hours every night and I do around 4 hours driving, 30 or so minutes of other work and around 4 hours of POA. That’s 9 hours of shift time but no break required for either the tacho or WTD rules.

I did the Split Break as it was when it came out
Then i had Assessment by big German Company who said Law has changed and i need for Driving if Split first 15min and 30min then, but the same for Woking Directive.
So i changed my habit with the Result that i got a Book full infringements at Tsco, becouse, they showed me Black on White that the Workingtime Directive recuires first 30min and then 15min
Now i do 47 min whatever and whenever i do Break.

A book full of infringements from Tesco isn’t worth the paper it is written on. They are talking ■■■■■■■■ :stuck_out_tongue:

As for the previous poster, if he took a break from a to b driving at 4 hours, that has more than satisfied the RTD

But I just noticed that tachograph had already said that

Tesco need a little help.
