OK, thought of this one today, say you start sunday with 6 hours left of your 90 hrs then countinue to drive after midnight, could you carry on after 00:00 and do a 10 hour shift?

i dont think so no because you will have started the shift on the previous week so everything that you do will count on that said week im 99percent sure of that

Yes you can . The weekly or fortnightly driving limits are up to midnight Sunday .So as you reach midnight Sunday the driving time will drop off from 2 weeks ago .

The fact you are starting your shift in one week and finishing in the next week has no bearing in this.

The driving limits are per week . A week is 0000 Monday to 2400 Sunday this does not change depending on when you started a shift . Next time you do a shift on a Sunday/Monday morning , stop just before 0000 on Monday and make a note of your fortnightly driving total , then look again at 0001 and you will see that the number is smaller.

NB at this time of year it will be 0100 local time .

As jimboy124 said the weekly/fortnightly driving limits are bound to the fixed week, so the clock is reset at midnight Sunday (00:00 Monday).

In your example the weekly driving limit would be reset at 00:00 Monday so you could legally continue driving into Monday, the fortnightly driving limit would be for the week you’ve just completed and the week you’re about to do.

From (EC) 561/2006
Article 4:

‘weekly driving time’ means the total accumulated
driving time during a week;

Article 6:

  1. The daily driving time shall not exceed nine hours.
    However, the daily driving time may be extended to at most
    10 hours not more than twice during the week.

  2. The weekly driving time shall not exceed 56 hours and
    shall not result in the maximum weekly working time laid
    down in Directive 2002/15/EC being exceeded.

  3. The total accumulated driving time during any two
    consecutive weeks shall not exceed 90 hours.
