Mobile hgv driver and 10hours night time work rule?

Got question,
I m gonna do some trunking work on friday night and just wondering, does 10hours night working time rule apply for mobile workers(drivers)?
as just thinking what if I wont be back on time,
thanks for any help advice

Going to do some trunking on friday night, 6pm start, so do I have to be back at depot latest 4:45? (icl. 45min rest break) as wondering if wont get back quick enuf I stuck in the truck for daily rest break?

Legally unless there’s an opt out agreement in place night workers are restricted to 10 hours working time, working time does not include breaks or POA.

If there is an opt out agreement in place you can legally work the same as day workers or whatever hours is specified in the opt out agreement.

Having said that, no-one at a roadside check point will check to see if there’s an opt out agreement in place, so unless your company cares it’s unlikely that anyone else will either :wink:

To be honest, as an agency driver wherever I’ve worked I have never bothered to find out if they have an opt out agreement in place nor have I ever discussed it with an agency.

I did try to post it last night with no luck,
so decided to try today morning as couldnt see my post, so did it again, which shown up, then I just checked and looks as posted twice,
