No idea. The tank was shut off and marked do not use, I drove it the other night and it is still this way even though it no longer goes to the mainland, and the vehicle continued to go to Germany with no further problems regarding the tank.
As I understand it the regulations state you can carry as much fuel as you like into most European countries including Germany as long it is in the standard fuel tanks for the vehicle, if it is not you are bound by the old 200litre regs. Some of our drivers have been fined for this but have also been told by the police that if they buy fuel in Germany that they will turn a blind eye as it is contributing to the German economy so that would seem to be the way to go.
One of our drivers has just been fined €155 in Bielefeld for having a after market diesel tank fitted to the Mercedes he is driving . The tank is properly fitted to the vehicle and is in direct use for running of the vehicle .
I have the letter in my possession if you would like to read it i will email it to you .
One last thought … if the vehicle has passed a MOT in this country surely this should be OK in all countries throughout the EU ,

Is it the actual tank he was fined for,or the amount of diesel he was,or is able to,carry?
I seem to remember somewhere that if a vehicle is carrying a certain amount of diesel,it comes under ADR regs.

The amount he had in the tank was around 300 litres . Which I think does not come under ADR regs .
Thats news to me,what next? loads of trucks running around with 500ltr + tanks fitted especially some of your foreign trucks ,you never hear about them being done pathetic if you ask me

It’s the size of the tanks that counts mate, rather than the actual amount of fuel carried in them at a time.
For fuel carried in vehicle tanks (for the propulsion of the vehicle,) ADR sets a total limit per vehicle of 1,500 liters but there’s no limit in ADR on how many tanks make up the allowed 1,500 liter total.
It’s possible that it’s a different law that was used to ‘nick’ the driver.
Can you tell from the letter which law was alleged to have been broken please?

then you get done, and they have been doing every one, honestly,can you
copy the letter and let us read it as then , can we give you perhaps a
argument against the fine

Vehicle tanks must be tested and carry a marking to prove they have been, basically original equipment or specially designed for the vehicle and tested.
I think the law is the same throughout the EU and was probably brought in after the Brits used to go to Oman with their grannys dolly tub roped on under the trailer

Stvo = Strassen VERKEHRS Ordnung = German Highway Code
Stzo = Strassen ZULASUNGS Ordnung = German Constuction and use
The basics are, the OWNER gets done for Stzo and the DRIVER for Stvo
Example The driver drives over a red light = Stvo driver fined
The fist aid kit shelf life has run out = Stzo the owner fined
Bald tyre =Stvo fine for the driver for using the veh on a public road and Stzo fine for the owner for letting
the veh to be used on a public road

As I said before plain ann simply you have fitted a tank which is not reconised
as being one for that particular vehicle,if however you can get a letter certificate
saying this has been reconised and allowed by the UK authorities you may be able to over turn
the fine,

Your quite right pete , i have just got off the phone to my friend Wolfram who is a German truck driver , he is going to the border at Aachen for further clarification and to get infomation on the correct way to about an appeal .

There is a limit of 1000ltr per tank though and as for the tank itself - I know many trucks that can’t go to germany because their tanks are not oem and they don’t have the proper certificate either.
