Payroll parasite Legitas comes under HMRC spotlight

A PAYROLL outfit we exposed for running a multi-million pound tax avoidance scheme has come under the scrutiny of HM Revenue and Customs.
Legitas has this week announced it is suspending a controversial scheme to claim tax breaks on behalf of 20,000 agency workers.
Two years ago we revealed that Legitas - then known as Legal E - put just 9% of the benefit from this scheme back into the pockets of the workers, sharing the rest of the profit with the agency that recruited them.
The company, which is run by a struck-off former solicitor, could be costing HMRC up to £48million a year based on the company’s own predictions of what it could claim for a typical worker.
Eva Pulik, who lives in Hitchin in Hertfordshire, told us she was baffled when she found the payroll firm had claimed she spent £175 out of the £327 she earned in one week on food and travelling.
Legitas admitted that “errors” had been made in the past but a “rigorous internal auditing system” had been put in place. Legitas is run from Edinburgh by David Allen (above), 58, from Watford, Herts, who in 2000 was struck off as a solicitor for “using clients’ money to keep his firm going”.
Now Legitas has announced that it is putting all temps on to the standard Pay As You Earn system “for a short period of time, with immediate effect”.
The firm insisted “no legal issues have been found with our current model” and it was “working with HMRC to set and implement a real-time model for the processing of temporary worker payments”.
But an HMRC spokesman denied the agency helped design business models. He said: "We are unable to comment on specific taxpayers.
“HMRC does not help businesses to develop models. In our statements of July 2011 and August 2012 we made clear our views on ‘pay-day’ models. We continue to stand by these statements and will pursue businesses that do not comply with the rules.”
I wouldn’t be surprised if “standard PAYE system” means emergancy tax coding for EVERYONE, meaning they’ll STILL be living off worker’s wages, sitting on collected over-paid tax in a similar way to the gas company who’ve just jacked up my direct debit by 60 bloody percent per month/
It would be nice to think that the sham S/E driver will go the same way as the sham IT consultant of years past but with the current economic climate I doubt whether it will happen - too many large companies rely on drivers willing to work all hours for little reward and the last thing the government want is a load of drivers being forced onto the dole so for the time being I can’t see a change in HMRC turning a blind eye to the majority of the industry - this leech just probably failed the ‘attitude test’.

Why would they all become unemployed?
The work will still be there, will just mean having to go on the books properly. As for HMRC, they’ll get a bigger payout each week as the expenses will have to be claimed back at the end of the year instead of through the year as these scams do. Added to which, alot of drivers won’t bother with reclaiming them as seeing it as a hassle.

They should ban all these umbrella companies simples. If you work for an agency you should be paid direct and employed by them. Being self employed should be banned as well its all a fiddle, no wonder the rates for you guys are so bad

Over the last 6 weeks I have been paid no less than £800 a week

The companies would have to start paying the going rates, covering for Tax, NI, holidays, so where they may have been able to take on two agency drivers, at minimum hours, they are now going to take on one driver and max - out his hours, making sure they are running full loads etc. Hence there will be fewer drivers needed and those that currently do part-time driving will find that starts to dry up.
As far as HMRC are concerned, if they were interested in collecting tax due they would already have stopped sham S/E but, as with Vodafone, it currently suits the government to tell them to turn a blind eye for political reasons. That may change when or if the economy starts to improve but until then it will stay the same.

I earn that week in week out. Is it a good wage? Nah, it’s £400 p/week but I do a fortnights work every week!
I bet that blokes bricking it now, wouldn’t want the taxman after me!
